AND I WANT TO POINT OUT THAT OBVIOUSLY PUBLIC HEALTH, SAFETY, CONVENIENCE, AND WELFARE AS CITIZENS IS THE PREDOMINANT JOURNEY THAT THE PLANNING COMMISSION IS ON.
LIKE ALL OTHER THINGS, WHETHER IT BE, UH, HEALTH AND SAFETY FROM SHERIFFS, EMT, FIRE, WHATEVER THE CASE MIGHT BE AND HAVE A HEALTHY SURROUNDINGS COMING OUT OF THAT AND ANALYSIS.
WHAT WE DISCUSSED IS THE FACT THAT THERE ARE DIFFERENCES IN THE ORDINANCE CODE THAT PERTAINS TO THE ACCESS CAPABILITIES OF ROADS.
AND FOR EXAMPLE, IN 6 32, YOU'LL SEE THAT IN ONE CASE IN YOUR NICHE, IT'S CLASS TWO, IN ANOTHER CASE, IT'S CLASS THREE, THOSE CASES GOING BACK ARE REALLY DELINEATED IN THE TWO DIFFERENT PARTS OF THE ORDINANCE BY THE AMOUNT OF TRAFFIC THAT GOES THROUGH THOSE PARTICULAR ROADS IN THOSE INTERSECTIONS.
WHAT IT SHOWS IS THAT IT BOTH CLASSIFICATIONS, SHOULD THEY ACCESS CATEGORY THREE? AND THAT'S WHAT I WAS ASKING THAT, UH, PLANNING COMMISSION WOULD CHANGE.

UM, THE REQUEST IS TO RESIGN FROM AGRICULTURAL 82 TO RESIDENTIAL ARWAN AND 49.37 ACRES.
UM, THIS IS LOCATED IN THE CENTER OF THE COUNTY, ACTUALLY LOCATED WITHIN THE COURTHOUSE VILLAGE BOUNDARIES.
THE PROPERTY IS A TWO AS WELL AS THE SURROUNDING PROPERTY SURROUNDING PROPERTIES ARE PRIMARILY HAVE A, EITHER VACANT OR THEY HAVE SINGLE FAMILY, RESIDENTIAL DWELLINGS ON THEM.

UM, THE PLAN GROWTH GUIDANCE DOES PROVIDE IN PRACTICE CONSIDER THAT POTENTIAL INCREASES IN PLAN DENSITY WITH PROVISION OF PUBLIC WATER AND SEWER MAY BE APPROPRIATE, UM, AS YOU ARE ALL AWARE AND HOPEFULLY THE CITIZENS IN THE AND THE AUDIENCE CAN PARTICIPATE THAT THEY'RE AWARE AS WELL, THAT THE CURRENT COMPREHENSIVE PLAN FOR COURTHOUSE VILLAGE IS UNDER EVALUATION.
UH, THIS IS AN AERIAL OF THE PROPERTY.
UM, THIS PROPERTY HAS BEEN TEMPERED IN RECENT YEARS.

UM, THERE WAS ALSO A HUNDRED FOOT BUFFER THAT SURROUNDS THE ENTIRE PERIMETER OF THE NEIGHBORHOOD.
UH, ROAD IMPROVEMENTS ARE BEING PROVIDED TO FAIRGROUND ROADS INCLUDE RIGHT AWAY DEDICATION WITH RIGHT AND LEFT TURN LANES THAT MEET OUR STANDARDS.
UH, THERE'S ALSO CONSTRUCTION OUR LIMITATIONS AS WELL AS THE CASH PROFFER CONSISTENT WITH OUR CAPITAL IMPACT MODEL.
UH, THIS IS THE LAYOUT OF THE NEIGHBORHOOD.
UM, PRIOR TO THE LAST MEETING, UH, THERE, IF YOU NOTICE THE RED CIRCLES THAT ARE HERE, WHERE THEY INCREASED TO MAKE SURE THAT WE HAD A 200 FOOT STORAGE AND 200 FOOT TAPER FOR THE RIGHT AND LEFT TURN LANES, UM, THERE'S A STUB ROAD TO THE NORTH AND YOU CAN SEE THE PERIMETER BUFFER THAT BASICALLY, UM, COMPLETELY SURROUNDS THE PROPERTY.
UH, THE BLUES ARE POTENTIAL, UM, LOCATIONS FOR BNP OR STORM WATER FACILITIES.
COULD FLUCTUATE ON THE ULTIMATE DESIGN.
SO WHAT'S UNIQUE ABOUT THIS CASE.
WE HAVE THAT ACTUALLY THREE COMMUNITY MEETINGS FOR IT OVER A VERA OVER SEVERAL MONTHS.
UM, OCTOBER, 2021, WE HAD THE FIRST MEETING, WE HAD SIX CITIZENS ATTENDING.
UM, THE PRICE AT THAT TIME WAS FOR 23 LOTS.
UH, THE CONCERNS FROM THE COMMUNITY WERE RELATED TO IMPROVEMENTS SOME FAIRGROUND, ROADS, DRAINAGE, BUFFERS, UM, STUB ROAD LOCATION.
UM, AND THEN THE CONCERN ABOUT THE LACK OF PUBLIC WATER FOR THAT, FOR THE PROJECT AND THE IMPACT ON EXISTING WELLS AND ALSO DISCUSSION REGARDING, UH, IS IT POSSIBLE TO BRING WATER UP TO THE AREA, UM, WHEN ASKED BY THE APPLICANT AT THAT TIME, ATTENDANCE, CITIZENS ATTENDING CITIZENS, DID EXPRESS ACCEPTANCE OF INCREASE IN DENSITY.
IF THE DEVELOPMENT WOULD PROVIDE WATER TO THE SITE ON DECEMBER, 2021, UH, WE HAD A SECOND MEETING, UH, NON-CITIZENS ATTENDED, UH, AT THAT TIME PROPOSAL WAS FOR 27 LOTS.
UM, WE HAD SIMILAR CONCERNS AGAIN REGARDING, UH, FAIRGROUND ROAD, UM, SERVER LOCATION.
AND THEN THERE WAS CONCERNED ABOUT THE IMPACT OF SEPTIC, UM, THE SEPTIC AND THE DRAIN FILLED SOME EXISTING LOTS.
UM, AND THAT AT THAT TIME, THE DEVELOPMENT WAS PROPOSING THE USE, UH, SEPTIC.
UM, THERE'S ALSO CONCERNS SHARED ABOUT AGAIN, FAIRGROUNDS ROAD AND INCREASE, POTENTIALLY INCREASE THE PROPERTY VALUES SURROUNDING THE PROPERTY.
UM, IN FEBRUARY, 2022, WE HAD A MEETING WITH 25 CITIZENS PROPOSAL AT THAT TIME WAS 4 47 LOTS.
AGAIN, THE CASE BEFORE YOU TONIGHT IS FOR 40 LOTS, UM, CONCERNS AT THAT TIME WAS REALLY DEVELOPMENT AND PUBLIC FACILITIES, UM, POTENTIAL IMPACTS TO SCHOOLS, THE LIKE FAIRGROUND ROADS, TRAFFIC, AND IMPACT, UM, AND ALSO CONCERNS.
CAUSE THERE WAS DISCUSSION ABOUT A POTENTIAL TRAIL GOING HERE TO HIDDEN ROCK PARK.
UM, THERE WAS CONCERNED ABOUT NEW RESIDENTS TRESPASSING ON THE ADJACENT PROPERTY TO ACCESS HIDDEN ROCK PARK.
THERE IS NO ACCESS TO HIDDEN ROCK PARK FROM THIS DEVELOPMENT PROPOSED.
UM, THE COMMUNITY COMMENTS THAT WE RECEIVED, AND THIS IS REALLY CUMULATIVE ACROSS THE CASE.
UM, WE HAVE RECEIVED ONE EMAIL AND SUPPORT 14 EMAILS RECEIVED AN OPPOSITION, PRIMARY REASONS THAT THE OPPOSITION HAD BEEN TRAFFIC AND SAFETY ON FAIRGROUND ROADS AS WELL AS GENERAL IMPACT IN GENERAL COMMENTS ABOUT GROWTH IN THE COMMUNITY AND IN THE AREA AND ENGAGE LYNN COUNTY AS A WHOLE, UM, STAFF REMAINING CONCERNS FOR THIS CASE.
UH, THE PROPERTY IS LOCATED IN THE COURTHOUSE VILLAGE.
IT DOES EXCEED THE CURRENT LAND USE RECOMMENDATION OF RESIDENTIAL LOW DENSITY.
I DID NOTE BEFORE THAT THERE IS A POTENTIAL INCREASE IN DENSITY RECOMMENDED IN THE PLAN SO THAT YOU HAVE BOTH PUBLIC UTILITIES.
UM, THE LAND USE CALLS FOR LOTS ON TWO

ACRES, UH, 40 LOTS ARE PROPOSED, WHICH GIVES US A DENSITY OF ABOUT 0.8, ONE UNITS PER ACRE PROPOSE, UH, SIDEWALK SHOULD HAVE BEEN PROVIDED RECOMMENDED THROUGH UNDER THE VILLAGE PLAN TO BE EXTENDED ALONG FAIRGROUNDS ROAD UNDER THE PLAN THAT'S NOT BEING PROVIDED.AND THE COURTHOUSE PLANET VILLAGE PLAN ITSELF IS UNDER EVALUATION, WHICH MAY ADJUST ENTITIES AND LAND USE RECOMMENDATIONS.
OTHER COMMENTS, THE APPLICANT DOES PROFFER THE WATER AND SEWER FOR LOTS AND EXTENDED TO THE PROPERTY.
UM, THE ROAD IMPROVEMENTS NECESSARY OUTSIDE OF THE SIDEWALK AND THE ROAD DEDICATION IS BEING PROVIDED BY THE APPLICANT.
THERE IS ALSO A PENDING V DOT QUARTER STUDY FOR FALLOW GROUND RAY, WHICH WE'LL LOOK AT SOME POTENTIAL ROAD IMPROVEMENTS FOR SAFETY AND THE LIKE, AND SOME, THEIR COMMENDATIONS MAYBE LEAVE FOR THE ULTIMATE DESIGN.
BUT THAT STUDY HAS NOT YET STARTED.
I BELIEVE IT'S, IT WILL BE STARTING SHORTLY AND THAT'S A BEAT OUT STUDY.
SO PREVIOUSLY, JUST TO REMINDER OF WHERE WE WERE IN MAY, UM, WE, THERE WERE FOUR MEMBERS HERE THAT NIGHT.
THERE WAS ACTUALLY A TIE VOTE BETWEEN THE MEMBERS PRESENT.
UH, WE HAD FIVE CITIZENS SPEAK IN OPPOSITION AT THAT PUBLIC HEARING.
UM, IN BOTH JUNE AND JULY, THE APPLICANT REQUESTED DEFERRALS AND THEY WERE ACCEPTED BY THE COMMISSION QUICK SUMMARY OF THE PROFFERS.
I WON'T WALK THROUGH ALL THE PROFFERS, UM, ONE BY ONE, BUT JUST SOME HIGHLIGHTS AND REMINDERS.
THERE IS A CONCEPTUAL PLAN THAT, THAT SHOWED YOU TONIGHT.
THERE'S ALSO BUILDING ELEVATIONS THAT ARE PROPOSED FOR THESE AS WELL AS SOME SQUARE FOOTAGE PROVISIONS.

IT IS A MAJOR THOROUGHFARE TO GET FROM THE HIGH DENSITY AREA THAT WE CURRENTLY HAVE IN OUR DEVELOPING.
SO IF WE LOOK AT WHAT'S ALREADY APPROVED, IT'S NOT JUST ABOUT 40 HOMES.
IT'S WHAT IS OUT THERE IN TERMS OF 228 PLUS NOW I WILL ADD THAT THIS IS SLIGHTLY OUT OF DATE BECAUSE I BELIEVE THE OCCUPIED HOMES HAS GONE UP AND READ MARSH NOW, BUT THERE'S ALSO SOME HOMES FOR SALE.

SO YOU DON'T GET THE SPRAWL THAT EXCUSE ME, THAT YOU SEE IN CHARLOTTESVILLE WHERE I LIVE, OR YOU SEE IN CHESTERFIELD OR OTHER COUNTIES, YOU HAVE DESIGNATED GROWTH AREAS.
AND THIS PROPERTY IS IN THE GROWTH AREA.

UM, THE UTILITY MASTER PLAN SHOWS WATER AND SEWER BEING EXTENDED UP FAIRGROUNDS THROUGH THE VILLAGE.
AND, YOU KNOW, AT COUNTY EXPENSE AND MR. GREENBAUM IS PUTTING THAT IN AT 1700 FEET OF IT WITH THIS PROJECT.
SO IT'S ALREADY SHOWN YES, AND WE'VE ALL PROVIDING FIRE HYDRANTS.
UH, YOU KNOW, THERE WILL BE HYDRANTS IN THE NEIGHBORHOOD AS WELL.
WE DID A WATER PRESSURE ANALYSIS.
WE DID A BUNCH OF STUDIES AS WELL TO VERIFY THAT WE HAD ENOUGH PRESSURE AND CAN MEET THE DEMAND FOR FIRE FLOW.
UM, SO MR. ROCKER, CHARLIE HAD A QUESTION EARLIER ABOUT AN ADJACENT PIECE OF PROPERTY.
IF THEY WANTED WATER AND SEWER, THE ANSWER IS YES.
WELL, WHAT IS THE 14 INCH LINE? 14 INCH LINE WILL SERVE? SO, SO THE WATERLINE IS A 12, 12 INCH LINE.
AND RIGHT NOW THE ULTIMATE RESTRICTIONS GOING TO BE FROM THE LINE AND THE COURTHOUSE VILLAGE ITSELF.
AND SO WE'RE PUTTING IN A LARGER LINE.
SO IN THE FUTURE, WHEN IT IS EXPANDED, IT COULD EVEN PROVIDE MORE PRESSURE AND FLOW.

UM, A LOT OF THE WATERLINE IN THE COUNTY AND THE COURTHOUSE ARE 10 INCH LINES, WHICH ARE KIND OF OLD AND OUTDATED, AND THAT'S NOT WHAT'S PUT IN ANYMORE.
THEY USUALLY GO TO A EIGHT TO A 12 OR SOMETHING LIKE THAT.
SO WE'RE PUTTING THE LARGER LINE TO ALLOW FOR MORE CAPACITY NOW IN, IN THE FUTURE.
TO ESTIMATE, BUT I DON'T KNOW EXACT NUMBER OF UNITS, HOW MANY ADDITIONAL IT COULD BE SORT OF, I DO NOT KNOW THAT OFF HAND.

IF YOU BUILD A DUEL COM AND IF YOU PUT THE WATER AND SEWER IN, WE KNOW THEY'RE GOING TO COME AND MORE AND MORE DEVELOPMENT WILL BE IN AN AREA THAT REALLY WASN'T DESIGNED TO HANDLE THAT MANY PEOPLE.
IT WAS SUPPOSED TO BE US ON A SMALL VILLAGE PLAN WITH NOT 15 TO 20,000 HOMES THAT COULD GO IN THERE.
BY THE TIME YOU KEEP SPREADING, I KNOW WHERE I LIVE AND THE EASTERN END, EVERY TIME YOU TURNED AROUND, WE WERE REZONING A TRACK OF LAND FROM ONE OLD HOUSES.
AND SO IT JUST SEEMS LIKE TO ME THAT THIS PARTICULAR DEVELOPMENT IS KIND OF GOING THE WRONG DIRECTION.
UH, IF WE JUST STAYED WITH THE ORIGINAL 23 LOTS, UH, WHERE THE, ABOUT THE COMPREHENSIVE PLAN, IT WOULDN'T BE AS, AT ONE MINUTE MUCH TRAFFIC ON THE ROAD.
IT WASN'T A REQUIRED EXTENSION OF WATER AND SEWER THAT MORE LOTS CAN TIE INTO.
SO, UM, UH, I JUST LIKE TO HEAR WHAT THE OTHER COMMISSIONERS SAY, BUT I HAVE A PROBLEM WITH KIND OF THE DIRECTION THIS PARTICULAR PROJECT IS GOING.

UM, THERE'S ALSO BEEN A COUPLE OF COMMENTS ABOUT NOT BEING ABLE TO GET ENOUGH SERVICES, UH, THE EMS PERSON ON THE OTHER, UM, LADY WHO, YOU KNOW, SAYS THAT THE FOOD LINES WERE CROWDED AND WE DON'T HAVE A LOT OF OPTIONS.
I THINK GROWTH DRIVES THOSE THINGS.

WELL, UM, ASHLEY, ARE YOU CONCERNED ABOUT THE DENSITY TO HIM BECAUSE HE HAS A, B, C THIS STARTED OFF ABOUT 23 HOUSES, 20 HOUSES NEAR AND IT'S DOUBLE OR THREE.
AND I CERTAINLY UNDERSTAND THE NEIGHBORS CONCERNED ABOUT THE, UH, ABOUT THE TRAFFIC, BECAUSE IT IS PRETTY BAD WHEN I POOP AROUND ROAD.

UM, THEN THE NEXT WAS, UM, RELATION TO, UM, IMPACT POTENTIALLY ON DRAIN FIELDS AND BE ABLE TO FIND DRAIN FIELDS FOR THE SITES.
AND SO THAT WAS, THAT'S WHY, WHICH IS UNUSUAL.
USUALLY WE START HIGH AND COME DOWN THIS SCENARIO, THEY STARTED LOW AND ADJUSTED, UM, IN PART, IN RESPONSE TO THE COMMUNITY.
UM, FOR THAT TO BRING THOSE SERVICES IN TO PROGRESSION WAS WE STARTED WITH 20 AND WE WERE WORRIED ABOUT THE EFFECT ON LOCAL WELLS.
SO THEN THEY BROUGHT IN WATER AND IT MOVED UPWARDS FROM 20 TO SOMETHING ELSE.
AND WE WERE WORRIED ABOUT SEPTICS.
SO WE'D MOVED UPWARDS TO SO, SO, SO MY CONCERN IS, AND I MAY, I SPOKE ON THIS LAST TIME, SO THIS IS A NICE LOOKING, THE WAY IT'S DONE IS IT'S PRESENTED NICELY.

UM, BUT YOU KNOW, UM, THAT'S SOMETHING WE'D HAVE TO DISCUSS TOTALLY, BUT THE HEALTH DEPARTMENT, PEOPLE DO HAVE CONCERN.
UM, AND JUST TO CARRY ANECDOTALLY, WHAT WAS SHARED AT THAT MEETING IS PEOPLE FELT LIKE THAT THERE HAD BEEN SOME OTHER NEW HOUSES IN THE AREA AND THEY FELT LIKE THEY HAD LOST A LITTLE BIT OF CAPACITY OR PRESSURE FOR THEIR WELLS AND THE INITIAL MEETING FOR THAT.
UM, YOU KNOW, THERE ARE, YOU KNOW, PERIODICALLY PEOPLE HAVE TO DIG NEW WELLS, DO DIFFERENT TYPES OF THINGS IN PENCIL, AS YOU, AS YOU'RE AWARE, JUST THAT, THAT FOR THOSE TAPPED INTO, UH, DIFFERENT SOIL CAPACITIES FOR DIFFERENT SEPTIC, UM, YOU KNOW, IN MY CAREER EXPERIENCE, YOU KNOW, OF COURSE HAVEN'T BEEN ENGAGED ON THAT TIME, BUT I KNOW THAT IT'S, IT'S A COMMON OCCURRENCE.
PEOPLE HAVE THAT FAILURE, UM, YOU KNOW, FOR THE UTILITIES, BUT AS PROPOSED FOR THIS AS PART, IT IS IN KEEPING WITH THE MASTER PLAN THAT UTILITIES ALREADY HAS, HAS FOR THE AREA.
UM, SO EVENTUALLY IT WAS LIKELY THROUGH OUR OWN MASTER PLAN FOR UTILITIES THAT UTILITIES WAS PLANNED FOR THE AREA ALREADY HAD A CERTAIN AMOUNT, EXACT CAPACITY.
WHEN YOU GET TO THOSE NUMBER OF HOMES, I'D HAVE TO ASK SOMEBODY REALLY FROM UTILITIES TO, TO FULLY EXPLAIN, UM, EXACTLY WHAT THAT FULL TAP WHO CAN DRAW THAT TAP, UM, MEANS.

UM, SO THOSE, YOU KNOW, IF WHEN YOU DO RUN IMPROVEMENTS IN THE FUTURE WITH V THAT HOPEFULLY WOULD UPGRADED IN THE FUTURE, UM, THEY DO THE FURTHER IMPROVEMENTS THAT TO MAINTAIN TURN LANES AND THINGS LIKE THAT WITHIN THAT RIGHT OF WAY.
