DISTRICT'S TWO AND THREE WILL BE MONDAY, OCTOBER 17TH AT 6:30 PM RIGHT HERE IN THE COUNTY ADMINISTRATION BUILDING.

AND DISTRICT'S FOUR AND FIVE WILL BE WEDNESDAY AT THE RESIDENCE IN AT THE NOTCH.

UH, WE WOULD LOVE ALL THE PUBLIC TO COME OUT, UH, AND, UH, PARTICIPATE AND GIVE US, UH, AND, AND LET US HEAR FROM YOU, AND YOU CAN HEAR, UH, WHAT'S WHAT'S GOING ON IN THE COUNTY.

UM, ALSO, I DID WANT TO COMMENT FOR YEARS I WORKED IN THE FINANCIAL INDUSTRY AND WE WENT, UNDERWENT A LOT OF AUDITS.

AUDITS ARE, UM, CHALLENGING AND THEY ARE, UH, VERY, UH, NERVE WRACKING.

AND THE HIGHEST GRADE YOU CAN GET ON AN AUDIT IS, UM, ACCEPTABLE.

SO FOR A BUNCH OF OVERACHIEVERS, GETTING AN ACCEPTABLE RATING IS NOT, UH, IT DOESN'T FEEL GREAT.

BUT I DID WANNA ACKNOWLEDGE THAT THE, OUR OUR, UH, THERE WAS AN AUDIT OF PUBLIC ACCOUNTS DONE FOR OUR TREASURER, OUR COMMISSIONER OF REV REVENUE AND OUR SHERIFF, AND THEY ALL RECEIVED ADEQUATE AUDITS.

SO CONGRATULATIONS TO THEM.

AND JUST, AGAIN, A TESTAMENT THAT EVERY WE'RE LOOKING AT EVERY PART OF GIN COUNTY IS, IS EXTREMELY WELL MANAGED.

UM, WE'RE A BOONE HOMES, UM, WHERE GLAND BASED BUSINESS LOCATED AT 62 BROAD STREET ROAD MANNEQUIN S UM, I WANTED TO COME, UM, SPEAK BRIEFLY ABOUT THIS TODAY.

UM, I KNOW ALL OF YOU'RE BUSY AND MODIFYING BUILDER DEVELOPER REQUIREMENTS.

IT'S NOT AN EASY CONVERSATION FOR ANYONE.

UM, BUT I WANTED TO TAKE A MINUTE TO SHARE WHAT WE WERE ABOUT TO BE REQUIRED TO DO IN MOSAIC SECTION EIGHT.

IN REGARDS TO SIDEWALK ORDINANCE, AS A BELIEVE MOST OF YOU A NOTE, WE ARE REQUIRED TO HAVE ALL OUR SIDEWALK INSTALLED PRIOR TO 50% OF BUILDING PERMITS FOR OUR SECTION SECTION.

EIGHT 50% IS MAXING OUT AT 24 BUILDING PERMITS.

TO DATE, WE HAVE RECEIVED APPROVALS FOR 19 BUILDING PERMITS.

WE HAVE THREE BUILDING PERMIT APPLICATIONS THAT ARE IN THE COUNTY RIGHT NOW.

WE'RE WAITING APPROVAL.

WE HAVE TWO ADDITIONAL CONTRACTS THAT WE'VE SIGNED THAT WILL BE READY TO SUBMIT FOR BUILDING PERMITS WITHIN THE NEXT FEW WEEKS.

LASTLY, WE EXPECT TO HAVE THREE TO FOUR CONTRACTS THIS MONTH BASED ON OUR CURRENT CONVERSATIONS WITH CUSTOMERS.

IT'S GREAT.

UM, BUT THIS PUTS US AT THE 50% MARK WITHIN THE NEXT TWO MONTHS.

I HAD MY TEAM TAKE A RECENT DRONE VIDEO OF OUR SECTION TO SHOW THE CURRENT CONSTRUCTION PROGRESS THAT I'VE SENT TO CHAIRMAN SPOON HOWARD.

UM, BUT I WOULD AL ALSO BE HAPPY TO SEND TO THE REST OF THE BOARD AS WELL.

WHAT YOU WILL BE ABLE TO SEE FROM THE VIDEO IS THAT WE, WE ARE STILL SEVERAL MONTHS AWAY FROM HAVING CUSTOMERS IN OUR HOUSES IN THE SECTION BASED ON OUR CURRENT PROJECTIONS.

THE BEST CASE SCENARIO TO HAVE A CUSTOMER IS PROBABLY NOVEMBER, DECEMBER OF THIS YEAR.

BUT THAT COULD EASILY BE MOVED BACK DEPENDING ON DOMINION POWER OR COLUMBIA GAS INSTALLS.

IN ORDER TO NOT HOLD UP PROGRESS IN THE NEIGHBORHOOD, I WILL HAVE TO INSTALL THE ENTIRETY OF THIS SIDEWALK IN THE SECTION WITHIN THE NEXT COUPLE OF MONTHS.

THE COST TO INSTALL THE SIDEWALK IS COMING IN AT $228,871 FOR 3,700 LINEAR FEET OF FIVE FOOT WIDE SIDEWALK.

THIS EQUATES TO $4,670 PER HOUSE.

I HOPE THAT YOU WILL BE ABLE TO SEE FROM THE DRONE VIDEO THAT I SEND OUT, THAT, UM, THAT THE VAST MAJORITY, IF NOT ALL THE SIDEWALK THAT WILL BE INSTALLED WILL ULTIMATELY BE DESTROYED BY CONSTRUCTION ACTIVITY.

WE ARE PROJECTING THAT WE HAVE TO PAY FOR THE DEMO AND REINSTALLATION OF ALL OF THE SIDEWALK THAT WE INSTALL.

I REALIZE THAT MODIFYING THE ORDINANCE IS NOT A HIGH PRIORITY ITEM FOR THE BOARD, BUT I DID WANT TO BRING IT UP AND EX AND EXPLAIN THE ISSUE A LITTLE BIT BETTER FOR ALL OF YOU.

ON OCCASION, PEOPLE WILL SAY, WELL, THIS PRODUCER HAS PUT DOWN SOIL AMENDMENTS, ALSO KNOWN AS FERTILIZER, UM, AND IT'S MESSED UP MY WELL WATER.

AND MY QUESTION ALWAYS IS, WHAT WAS YOUR WELL WATER BEFORE THE AMENDMENTS WERE PUT DOWN? AND THEY USUALLY, WHY? I DON'T KNOW.

IT SAYS, RESIDENTIAL DEVELOPMENT TYPICALLY REQUIRES A DOLLAR 25 TO A DOLLAR 50 IN SERVICES FOR EACH DOLLAR IN TAX REVENUE.

SO THE FARMING COMMUNITY IS SUBSIDIZING THROUGH THEIR TAX ASSESSMENTS, AS I UPON IS SAYING, COWS DO NOT CALL 9 1 1.

UH, WE DON'T HAVE A LOT OF SERVICE REQUIREMENTS FROM THE AGRICULTURAL COMMUNITY, UH, SO FAR AS FIRE AND RESCUE LIBRARIES AND OTHER SIDE AND, AND THE SCHOOLS.

SO I REALLY APPRECIATE, AND I KNOW THE FARMING COMMUNITY DOES TOO, YOUR CONTINUING TO USE, UH, AND APPLY THE LAND USE OPTION.

CUMBERLAND COUNTY JUST ELIMINATED ONE OF THEIR LAND USE OPTIONS FOR A TIMBER, AND THAT IS GOING TO INCREASE THE TAX RATE BY ABOUT $1,200 PER ACRE.

UH, I'M GLAD TO SEE THAT REACTION FROM SOME OF THE BOARD MEMBERS.

SO WE VERY MUCH APPRECIATE THE LAND USE, UH, TAX RATE.

IT REALLY DOES BENEFIT THE COUNTY, AND I THINK IT ALSO ALLOWS THE COUNTY TO CONTINUE TO GROW GRACEFULLY AS OPPOSED TO, UH, EVERY TIME YOU TURN AROUND, THERE'S ANOTHER ROW OF CONDOS GOING UP.

UH, THIS WAS ORIGINALLY SIGNED ON SEPTEMBER 7TH, 2021.

UH, THE TRANSMITTAL LETTER OUTLINES EIGHT CHANGES TO PROVIDE CLARITY, REMOVE, OUTDATED OR REDUNDANT INFORMATION, AND ADD LANGUAGE FOR THE IMPLEMENTATION OF NEW FEDERAL FUNDING REIMBURSEMENT MODEL.

THE SECOND ITEM THAT WE HAVE IS AUTHORIZATION FOR THE COUNTY ADMINISTRATOR TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH A MO AND SOIL AND WATER DISTRICT.

UH, THIS IS REPLACING THE EXPIRED MEMORANDUM OF UNDERSTANDING, UH, WHICH IS ATTACHED.

UH, THE PREVIOUS MOU WAS EFFECTIVE FROM AUGUST 22ND, 2020 SECOND OF 2017, AND EXPIRED ON AUGUST 22ND, 2022.

UH, THE, UH, MO AND SOIL AND WATER DISTRICT VOTED TO APPROVE THE MOU AT ITS AUGUST 15TH BOARD MEETING.

THE THIRD ITEM IN FRONT OF YOU IS A RESOLUTION ADOPTING THE 2022 RICHMOND CRATER MULTI-REGION HAZARD MITIGATION PLAN.

UM, THE HAZARD MITIGATION PLAN IS REQUIRED IN ORDER FOR A JURISDICTION TO BE ELIGIBLE, ELIGIBLE FOR FEMA HAZARD MITIGATION GRANT FUNDS THE GOALS THAT THE PLAN OR AS FOLLOWS, TO REDUCE THE LOSS OF LIFE AND INJURIES TO DEVELOP AND MAINTAIN PUBLIC AND PRIVATE INFRASTRUCTURE TO EDUCATE AND TRAIN OUR CITIZENS REGARDING VULNERABILITIES AND ENHANCE CAPABILITIES OF LOCAL GOVERNMENTS.

WE ARE REQUIRED TO ADOPT THIS HAZARD MITIGATION PLANS BE ELIGIBLE TO RECEIVE GRANT FUNDS.

THE PLAN MUST BE UPDATED EVERY FIVE YEARS, AND IT WAS LAST UPDATED IN 2017.

AND THE FINAL ITEM ON THE AGENDA IS THE ADOPTION OF THE 2023 LEGISLATIVE AGENDA.

UH, THERE ARE EIGHT ITEMS THAT WERE UP FOR CONSIDERATION.

AGAIN, ONE, SUPPORTING THE ESTABLISHMENT OF LOCAL AUTHORITY OVER MARIJUANA ESTABLISHMENTS.

SECOND ONE IS VERIFICATION OF SOCIAL SECURITY NUMBERS FOR VOTER REGISTRATIONS.

UH, THIRD IS THE, UH, SUPPORTING SOUND STRUCTURALLY BALANCED STATE BUDGET AND FISCAL PRACTICES.

THE FOURTH IS OPPOSED NEW UNFUNDED MANDATES AND SUPPORT THE IMPLEMENTATION OF A SUNSET CLAUSE ON EXISTING UNFUNDED MANDATES THAT ARE IMPOSED UPON LOCALITIES.

THE FIFTH IS SUPPORTING INCREASED FUNDING AND EXPANDED EFFORTS AND IMPLEMENTATION OF NEW TECHNOLOGY THAT IMPROVES AND EXPANDS.

IT IS AN ACCESS TO HIGH SPEED BROADBAND.

THE SIXTH ITEM WAS REQUESTING A STUDY OF THE COMPENSATION BOARD FUNDING FOR THE OFFICES OF CONSTITUTIONAL OFFICERS, THE SEVENTH ITEM SUPPORTING THE PROTECTION OF EXISTING LOCAL GOVERNMENT AUTHORITY IN ALL AREAS, SPECIFICALLY INCLUDING REVENUE STREAMS AND LOCAL LAND USE DECISIONS.

SO THEY HAVE TO LOOK AT EVERY POLE IN THE FIELD, GO MAKE THOSE CHANGES.

THEN WHEN THE FIBER CREWS GET IN, THEY CAN PUT THE FIBER OUT.

WE'RE IN THE MAKE READY CONSTRUCTION PHASE ON MOUNT HOPE.

UM, WE STILL HOPE TO HAVE, UH, CONNECTIONS STARTED BY, UH, IN WINTER, THE FINAL CONNECTIONS.

BUT WE WERE ENCOURAGED TO REAPPLY THE FOLLOWING YEAR IN JANUARY AFTER THE FCC R DO AUCTION.

AND I'M GETTING IN THE WEEDS HERE A LITTLE BIT, BUT IN JANUARY WE REAPPLIED.

UM, LAST YEAR IN AUGUST, THEY TOLD US THAT WE WON THE AWARD.

AND THAT WAS GOOD NEWS.

WE SIGNED THE CONTRACT TO START THAT LAST MONTH.

IT TAKES THE GOVERNMENT A LITTLE WHILE.

SO THE PROJECT THAT WE FIRST SAID WE WOULD DO IN MARCH OF 2020, WE, WE ACTUALLY STARTED PREPARATION MAY.

WE HIT THE FIRST DEADLINE.

AND AFTER THE STAFF, UH, PRESENTS, THE BOARD MAY HAVE SOME QUESTIONS OF STAFF, AND THEN WE ALLOW, WE ASK THE APPLICANT TO COME UP AND, UH, THEY CAN SPEAK TO THE CASE AND WE WILL POTENTIALLY ASK THEM QUESTIONS AS WELL.

UH, IT'S, UH, LOCATED ON 49.37 ACRES.

UH, THE PROPERTY IS, UH, GENERALLY CENTRAL TO THE COUNTY.

UM, ON THE, THE, THE EXTREMES OF THE COURTHOUSE VILLAGE, UH, THE PROPERTY IS CURRENTLY ZONED A TWO AS WELL AS FOR A MAJORITY OF THE SURROUNDING PROPERTY.

UH, THE COMPREHENSIVE PLAN, UH, DOES DESIGNATE THIS AS SINGLE FAMILY RESIDENTIAL LOW DENSITY.

IT IS LOCATED WITHIN THE COURTHOUSE VILLAGE.

UH, THE COURTHOUSE VILLAGE PLAN ITSELF WAS DEVELOPED IN 2015.

UM, THE RESIDENTIAL DENSITY WERE GENERAL LIMITED BY THE UTILITIES CAPACITY.

UH, GENERALLY IT WAS SEWER AT THE TIME.

UH, CAPACITY OF SEWER HAS BEEN INCREASED SINCE THE ORIGINAL VILLAGE PLAN.

THE COMPREHENSIVE PLAN GROWTH, GUIDANCE AND PRACTICE DOES CONSIDER POTENTIAL INCREASES IN DENSITY WITH THE PROVISION OF PUBLIC WATER AND SEWER.

UM, AND AS, UM, YOU ARE, ARE AWARE AND HOPEFULLY THE PUBLIC IS AWARE, UM, WE HAVE THE COMPREHENSIVE PLAN FOR CORDELL VILLAGE UNDER EVALUATION AT THIS TIME.

UM, AS YOU CAN SEE, THE, THE PROPERTY ITSELF IN THE AERIAL IS, UM, VACANT.

THE PROPERTY WAS, UH, TIMBERED IN PAST YEARS.

SO AGAIN, THE REQUEST IS RE ZONING FROM A TWO TO R ONE.

THE PROFFERED MAXIMUM, UM, FROM THE APPLICANT IS FOR 40 SINGLE FAMILY RESIDENTIAL LOTS THAT GENERALLY YIELDS TO DENSITY OF ABOUT 0.81 UNITS PER ACRE.

UM, THE CONCEPTUAL PLAN BUILDING ELEVATION MATERIALS HAVE ALSO BEEN PROFFERED PUBLIC WATER AND SU BE, AND SEWER WOULD BE EXTENDED AND PROVIDED BEFORE THE LOTS.

UM, THERE'S ALSO PROPOSED A HUNDRED FOOT BUFFER ALONG FAIRGROUND ROAD, WHICH IS, UM, TYPICAL POLICY THAT WE ASK FOR FOR RESIDENTIAL SUBDIVISIONS ALONG ROADS.

UM, THEY'RE ALSO OFFERING A HUNDRED FOOT PERIMETER BUFFER THAT WOULD GO ALL THE WAY AROUND THE PROPERTY.

THE APPLICANT HAS PRO PREFERRED ROAD IMPROVEMENTS TO FAIRGROUND ROAD, UM, AS WELL AS DEDICATION WITH RIGHT AND TURN LANES MEETING OUR STANDARDS.

THEY HAVE OFFERED CONSTRUCTION HOUR LIMITATIONS AS WELL AS, UH, THE STANDARD CASH PROFFER.

SO HERE'S THE, UM, THE PLAN, UM, CONCEPTUAL PLAN IS PROPOSED BY THE APPLICANT.

UH, THERE IS AN ACCESS HERE ON TWO FAIRGROUNDS ROAD.

THE APPLICANT HAS OFFERED, UM, BOTH LEFT AND RIGHT TURN TURN LANES WITH, UH, 200 FOOT OF STORAGE, 200 FOOT OF TAPER, UM, CONSISTENT, UM, WITH THE, UM, UPDATED ACCESS MANAGEMENT ORDINANCE, UH, THERE IS A STUB ROAD, UM, TO THE NORTHERN PORT OF THE PROPERTY TO HERE.

UM, THERE IS A CEMETERY LOCATED HERE.

THIS WILL BE THE ACCESS FOR THAT.

UM, GENERALLY THE, THE BLUE THAT YOU SEE THERE ARE PROPOSED ARE POTENTIAL BMPS WITH THE DEVELOPMENT.

UM, LITTLE UNUSUAL WITH THIS CASE IS THAT THERE HAS BEEN A LOT OF INTEREST AND A LOT OF, UM, UH, WORK AND CHANGES THROUGHOUT THE, THE PROCESS ON THE APPLICANT HAS HELD THREE COMMUNITY MEETINGS, UH, IN OCTOBER, UH, SIX CITIZENS AND, UH, COMMISSIONER MYERS WERE IN TENANTS PROPOSED AT THAT TIME WAS FOR 23 LOTS.

UM, THE CONCERNS THAT AROSE DURING DISCUSSION RELATED TO IMPROVEMENTS ON FAIR GROUND ROAD, DRAINAGE, BUFFERS, THE STUB ROAD, UM, AND THE LACK OF PUBLIC WATER AND THE OF FEAR OF IMPACT ON THE EXISTING WELLS.

UM, AND A LOT OF DISCUSSION, UH, CAME ABOUT DURING THAT, ABOUT THE FEASIBILITY OF EXTENDING UTILITIES TO THE DEVELOPMENT.

UM, THE APPLICANT ASKED THE ATTENDEES AT THE TIME IF THEY ACCEPTED INCREASE IN DENSITY IN DEVELOPMENT THAT WOULD BE NECESSITATED BY THE COST OF EXTENDING WATER TO THE SEWER.

AND THEY EXPRESSED IT AT THEIR ACCEPTANCE.

UM, IN DECEMBER OF 2021, UH, WE HAD A SECOND MEETING, UH, SOME MORE, UM, CITIZENS ATTENDED, UH, NONCITIZENS FOR THAT.

THE PROPOSAL WENT FROM 23 TO 27 LOTS.

UM, CONCERNS AT THAT TIME, UM, WERE GENERALLY THE SAME AS BEFORE ABOUT IMPROVEMENTS TO FAIRGROUND ROAD AND CONCERNED ABOUT STUB ROAD LOCATION.

UM, WITH THIS PROPOSAL OF THE APPLICANT HAD TALKED ABOUT BRINGING WATER TO THE SITE, UM, CONCERNS AROSE ABOUT THE VIABILITY OF SEPTICS ON THE PROPOSED LIGHT AND THE IMPACT THE SEPTIC SEPTIC USE ON NEARBY LOTS.

UM, CITIZENS ALSO SHARED THEIR CONCERNS, UM, ABOUT THE EXISTING TRAFFIC ALONG FAIR GROUND ROAD, UM, AND ALSO CONCERN ABOUT RESULTING INCREASE IN PROPERTY VALUES FOR SURROUNDING PROPERTY FOR THIS DEVELOPMENT.

UM, IN FEBRUARY, UH, WE HAD THE LARGEST COMMUNITY MEETING.

UM, AT THAT TIME, UH, 25 CITIZENS ATTENDED.

THE PROPOSAL HAD NOW INCREASED TO 47 LOTS.

UM, AT THIS TIME, THE APPLICANT WAS PROPOSING BOTH WATER AND SEWER, UH, CONCERNS IN RELATED, UM, TO IMPACT THE AND PUBLIC FACILITIES, UM, SUCH AS SCHOOLS, ROADS, INFRASTRUCTURE, FAIRGROUND, ROAD TRAFFIC, AND NEW RESIDENTS TRESPASSING ON ADJACENT PROPERTY TAX SAYS HIDDEN ROCK PARK.

UM, THERE HAD BEEN TALK AT THAT POINT OF THE APPLICANT PROVIDING SOME SORT OF SIDEWALK OR PATH ACCESS OVER TO COMMUNITY, UM,

TO IN ROCK PARK THAT HAS BEEN REMOVED FROM THE CASE.

UM, THIS IS AN, UH, AT TIME, UH, LAST, PRIOR TO PUTTING THIS SLIDE SHOW TOGETHER, WE HAD RECEIVED ONE EMAIL AND SUPPORT, 14 EMAILS RECEIVED AN OPPOSITION.

IT'S MY UNDERSTANDING THE BOARD HAS RECEIVED ON MORE COMMENTS TODAY.

UM, THE CONCERNS ARE REALLY RELATED ABOUT TRAFFIC AND SAFETY ON FAIR GROUND ROAD IMPACTS ON SCHOOLS' GROWTH IN THE AREA.

UM, STAFF CONCERNS RELATED TO THIS PROPERTY IS THE PROPOSAL IS LOCATED IN COURTHOUSE VILLAGE.

IT DOES EXCEED THE CURRENTLY INDUCED RECOMMENDATION OF RESIDENTIAL, UM, LOW DENSITY.

WHAT THAT CALLS FOR IS LOTS ON TWO ACRES OR IF YOU'RE THINKING OF EQUIVALENT TYPE OF YIELD ON THE LANDS.

ABOUT 0.5, UM, DENSITY, UH, 40 LOTS ARE PROPOSED FOR THIS DEVELOPMENT WITH THE DENSITY OF EIGHT ONE UNITS PER ACRE.

UM, THERE IS ADDITIONALLY A SIDEWALK SHOULD BE PROVIDED ON FAIR GROUND ROAD FOR THE EXISTING COMP PLAN.

RECOMMENDATION, UH, AS YOU ALL ARE AWARE, AND WE MENTIONED BEFORE, CARDHOUSE VILLAGE PLAN IS UNDER EVALUATION, UM, THERE'S ALSO AN EVALUATION GOING ON FOR A FAIRGROUND ROAD WITH PDOT FOR WHAT THEY CALL A CORRIDOR STUDY ON THE EXACT SCOPING OF THAT IS STILL, UM, BEING WORKED OUT AND THAT WORK HAS NOT STARTED ON THAT, BUT ANTICIPATED A MAJORITY OF THATS BE FOCUSED ON SAFETY IMPROVEMENTS, PROBABLY ULTIMATE DESIGN OF FAIR GROUND ROAD, SHORT AND LONG TERM SOLUTIONS.

UM, THE APPLICANT DOES PRO FOR PUBLIC AND WATER SEWER FOR THE LOTS AND IT'S PROVIDES THE CAPABILITY TO EXTEND TO THAT PROPERTY AND BEYOND.

UM, THEY OFFERING THE, THE REQUIRED FAIRGROUND ROAD RIGHT OF WAY AND OTHER ROAD IMPROVEMENTS, UM, BEING MET, WHICH IS BEEN GENERALLY WHAT'S HAPPENED WITH OTHER DEVELOPMENTS ALONG FAIRGROUND ROAD.

WHAT'S BEEN INTERESTING IS GETTING THIS CASE THROUGH THE PLANNING COMMISSION.

UM, THERE WAS ORIGINALLY A TIE VOTE AT THE MAY PUBLIC HEARING.

UM, AT THAT TIME IT WAS RESCHEDULED FOR JUNE.

UM, THPO CITIZEN SPOKE OPPOSITION AT THE MAY PUBLIC HEARING.

AT THAT TIME.

IN JUNE, THE COMMISSION ACCEPTED A DEFERRAL REQUEST BY THE APPLICANT AT THE JUNE AND JULY MEETINGS, THE APPLICANT WAS TRYING TO FIND SOME SOLUTIONS, UM, POTENTIALLY FOR THE STUB ROAD AND OTHER TYPES OF, UM, ACTIVITIES.

UM, AT THE AUGUST MEETING, UM, THERE WAS A MOTION FOR APPROVAL THAT EMO THAT MOTION DID FAIL.

THUS, THE CASE COMES FORWARD TO YOU WITH A, UM, DENIAL RECOMMENDATION.

UM, 15 CITIZENS SPOKE AT THE MEETING, ONE IN SUPPORT, AND THE REST AND OPPOSITION STAFF HAS NOT RECEIVED ANY CHANGES IN THE APPLICATION SINCE THE HEARING BEFORE THE PLANNING COMMISSION.

UH, QUICKLY, INSTEAD OF LISTING EVERY PROFFER FOR YOU, UM, I'LL JUST GENERALLY RUN THROUGH THEM QUICKLY.

UM, CONCEPTUAL PLAN AND BUILDING ELEVATIONS TO INCLUDE, UM, BUILDING MATERIALS, UH, CALLS FOR A MAXIMUM OF 40 LOTS.

UH, ROAD IMPROVEMENTS ON FAIR GROUND TO CUR LEFT AND RIGHT TURN LANES A HUNDRED FOR BUFFER PERIMETER AND ALONG FAIR GROUND ROAD.

UH, ONE IS THE DEVELOPER IS A LITTLE BIT DIFFERENT THAN THE DEVELOPER THAT I'M NORMALLY USED TO WORKING FOR, AND THAT HE HAS INHERITED THE PROPERTY AND HE'S SINCERELY BEEN CORDIAL IN AND TRYING TO WORK WITH THE NEIGHBORS AND STAFF AS MUCH AS POSSIBLE.

AND I FEEL LIKE HE'S A REALLY GOOD GUY AND HE'S, HE'S REALLY TRYING TO PUT THE BEST PLAN FORWARD.

UH, THE OTHER THING IS WE STARTED OUT WITH A LOWER DENSITY AND KIND OF INCREASED THROUGH THE PROJECT, WHICH NORMALLY WE START WITH A HIGHER DENSITY AND KIND OF WORKED THE OTHER WAY.

SO THAT'S MADE IT A LITTLE UNIQUE AS WELL.

UH, WE'VE BEEN WORKING ON THIS PROJECT FOR ABOUT A YEAR NOW.

AT FIRST COMMUNITY MEETING WAS IN OCTOBER OF 2021.

UH, AS, AS RAY HAD MENTIONED, WE HAD THREE COMMUNITY MEETINGS AND WE'VE BEEN TO THE PLANNING COMMISSION TWICE.

SO I JUST WANNA BOUNCE THROUGH A COUPLE REAL QUICKLY THE PLANS THAT WE INITIALLY SUBMITTED.

SO THAT WAS THE FIRST PLAN THAT WE CAME IN WITH, WAS 23 LOTS.

THEN WE WENT TO 29 LOTS.

WE MOVED TO STUB ROAD IN A DIFFERENT LOCATION, THEN WE WENT TO 47 LOTS.

AND THEN WE CAME BACK DOWN TO THE PLAN THAT'S BEFORE YOU TONIGHT, UH, THAT HAS 40 LOTS.

AND THROUGHOUT ALL THE CHANGES THAT WE MADE WERE IN RESPONSE TO EITHER NEIGHBOR CONCERNS, UH, COUNTY CONCERNS, VIDO CONCERNS, AND WHAT, WHAT DROVE THAT WAS.

YOU KNOW, INITIALLY WE HEARD CONCERNS ABOUT WELLS AND SEPTIC AND BUFFERS AND THAT TYPE OF THING.

FAIRGROUNDS ROAD WAS ALWAYS THERE.

BUT AS WE IN, IN THE COUNTY, ALSO ENCOURAGED US TO CONNECT TO THE UTILITIES.

SO AS WE INCREASED THOSE UTILITIES AND CONNECTED THOSE UTILITIES, THERE WAS A COST ASSOCIATED WITH THEM.

AND SO WE TRIED TO OFFSET THAT COST WITH, WITH ADDITIONAL LOTS.

BUT WHAT IT ALSO ALLOWED WAS THE LOTS TO BECOME SMALLER LOTS, UH, AND, AND IT ALLOWED US TO CLUSTER THEM MORE AND TO GIVE A LARGER BUFFER AROUND THE PERIMETER.

SO WE WERE ABLE TO GIVE A HUNDRED FOOT BUFFER COMPLETELY AROUND THE ENTIRE PROJECT, WHICH IS KIND OF UNHEARD OF WITH A, WITH A RESIDENTIAL SUBDIVISION.

UM, WE'VE GONE BACK AND FORTH WITH THE COUNTY ABOUT THE TURN LANES AND, AND THE ACTUAL, THE RIGHT OF WAY REQUIRED FOR THE ULTIMATE FAIRGROUND SECTION.

SO WE'RE GIVEN 37 AND A HALF FOOT OF RIGHT AWAY ALONG THE WHOLE FRONTAGE OF THE PROPERTY FOR THE FUTURE ROAD EXPANSION.

UM, AND WE, WE MOVE THE STUB ROAD TO THIS LOCATION BASED ON, UH, VDOT S UH, REQUIREMENTS.

AND SO I WANT TO TALK ABOUT THE STUB ROAD A LITTLE BIT.

UH, VDOT REQUIRES TWO EXTERNAL CONNECTION POINTS TO A SUBDIVISION FOR THEIR SECONDARY STREET ACCEPTANCE REQUIREMENTS.

AND YOU HAVE TO MEET THESE REQUIREMENTS TO GET YOUR ROADS ACCEPTED INTO THE STATE SYSTEM.

ONE CONNECTION TO FAIRGROUND WOULD COUNT, BUT I HAVE TO HAVE A SECOND CONNECTION TO EITHER ANOTHER ROAD WHICH WE CAN'T DO, OR AN ADJACENT STUB ROAD STUB PARCEL, I MEAN A ADJACENT PARCEL.

SO THE STUB ROAD MUST DEDICATE RIGHT AWAY TO THE PROPERTY LINE, THE ROAD SEGMENT, UH, ADJO PROPERTY FOR FUTURE DEVELOPMENT TO PROVIDE CONNECTIVITY TO A FUTURE PUBLIC STREET NETWORK.

THE LOCATIONS BASED ON SPACING, TERRAIN AND REASONABLE EXPECTATION THAT THE FUTURE, FUTURE CONNECTION WITH THE FUTURE STREET IS POSSIBLE.

THE STUB ROAD ALSO HAS TO BE CONNECT, UH, CONSTRUCTED ALL THE WAY TO THE PROPERTY LINE.

SO NOT JUST THE RIGHT OF WAY, THE ROAD ITSELF HAS TO BE BUILT AS CLOSE AS POSSIBLE TO THE PROPERTY LINE.

THE VDOT RESIDENT ENGINEER HAS THE ULTIMATE DECISION ON WHERE THE STUB IS LOCATED.

UH, WE HAVE TRIED MULTIPLE LOCATIONS FOR THE STUB ROAD.

WE'VE HAD MULTIPLE CONVERSATIONS WITH VDOT.

WE'VE HAD A MEETING WITH VDOT THAT WE RAN AROUND ALL OVER TOWN FOR A HALF A DAY TO, TO GET ON THEIR SCHEDULE, UH, WITH A COUPLE JOINING PROPERTY OWNERS.

UM, THE DEVELOPERS AGREEABLE TO STUB IT IN ANY LOCATION OR NOT STUB IT AT ALL, BUT IT, WE ARE REQUIRED TO STUB IT.

AND SO THAT'S BEEN AN ISSUE WE'VE BEEN WORKING WITH AS SOON AS TODAY.

STILL CORRESPONDING WITH VDOT.

AND TO DATE VDOT, THE ENGINEER HAS BEEN UNWILLING TO STUB THE ROAD IN ANY OTHER LOCATION OTHER THAN WHAT WE HAVE.

UH, TALK ABOUT DENSITY IN THE COMPREHENSIVE PLAN.

UH, THE PROJECT COMPLIES WITH THE COMPREHENSIVE PLAN.

THE PROPERTY'S LOCATED IN THE COURTHOUSE VILLAGE, WHICH ONE OF THE TWO MAJOR VILLAGES DESIGNATED IN THE COUNTY'S COMPREHENSIVE PLAN.

THE COMPREHENSIVE PLA UH, PLAN STATES THAT MAJOR VILLAGES SHOULD FEATURE VARIED HOUSING TYPES AND DENSITIES.

MULTIPLE PROVISIONS WERE MADE IN THE COMPREHENSIVE PLAN TO ALLOW FOR HIGHER DENSITIES IF SEWER CAPACITY WERE TO BECOME AVAILABLE.

RECENT UPGRADES IN THE EFFICIENCY AT THE DEPARTMENT OF CORRECTIONS AND THE UPSIZING OF THE VALLEY VIEW FORCE MAIN HAVE MADE THE ADDITIONAL SEWER CAPACITY A, A REALITY.

THIS PROJECT IS NO DCI, NO DIFFERENT THAN REED MARSH OR RURAL HILL, WHICH HAD THE SAME LAND USE DESIGNATION AND WERE REZONED FOR HIGHER DENSITIES.

UH, THIS SLIDE SHOWS, UH, THE COURTHOUSE VILLAGE DENSITIES.

A LITTLE BIT HIGHER DENSITY THAN RURAL HILL, WHICH WAS 0.64.

RURAL HILL HAD PUBLIC WATER, BUT ONLY A PORTION HAD PUBLIC SEWER.

UH, REED MARONS ONES THEN HAD PUBLIC WATER AND SEWER, UH, AND THE VILLAGE OF HIDDEN ROCK WILL HAVE PUBLIC WATER AND SEWER, AND THE DENSITY WOULD BE 0.81 UNITS PER ACRE.

UH, TRAFFIC STUDY, THE INITIAL TRAFFIC STUDY WAS PERFORMED IN SEPTEMBER, 2021, ASSUMING 23 LOTS, AND WAS REQUIRED TO ANALYZE THE INTERSECTIONS OF FAIRGROUND ROAD AND MAIDENS ROAD, AS WELL AS FAIRGROUNDS ROAD IN THE SITE ENTRANCE.

THE TRAFFIC STUDY WAS UPDATED IN FEBRUARY OF 2022 TO INCLUDE THE 47 LOTS.

THE STUDY INCLUDED THE TRAFFIC FROM REED MARSH AND RURAL HILL AND SWANS, AND THAT'S COME UP A COUPLE TIMES WHETHER THAT WAS INCLUDED, IT WAS INCLUDED IN THE TRAFFIC STUDY.

UH, WHAT THE TRAFFIC STUDY

SHOWED WERE THAT THE TURNING MOVEMENTS AT MAIDEN'S ROAD AND FAIRGROUNDS INTERSECTION OPERATE AT THE SAME LEVEL OF SERVICE FOR THE 2024 BUILD OUT.

UH, WHETHER THE SUBDIVISION IS BUILT OR NOT BUILT, THE, THE, THE INTERSECTION WILL HAVE THE SAME LEVEL OF SERVICE.

TRAFFIC FROM THE SUBDIVISION IS INSIGNIFICANT TO THE OVERALL FUNCTIONALITY OF THE INTERSECTION.

AND THE, THE STUDY, UH, CAME BACK THAT NO TURN LANES WERE WARRANTED FOR THE SITE ENTRANCE AND WERE PROVIDING LEFT AND RIGHT TURN LANES.

THERE WAS SOME QUESTION, UH, QUESTIONING, UH, WITH THE CITIZENS ABOUT THE TRAFFIC COUNTS DUE TO COVID.

SO WE WENT BACK OUT AND RECOUNTED THEM IN SEPTEMBER, 2021, AND THE TRAFFIC NUMBERS CAME BACK IN, UH, ESSENTIALLY THE SAME AS THEY WERE FROM THE FIRST COUNT.

UH, THIS SLIDE IS GONNA MAKE ME THE MOST POPULAR PERSON IN THE ROOM, I ASSURE YOU.

SO I, I WORKED WITH THE TRAFFIC ENGINEER AND, AND, AND IT SYMBOLS SOME VDOT DATA JUST TO KIND OF PUT THIS OUT THERE.

SO BASED ON 2021 TRAFFIC DATA FROM VDOT, THAT SECTION OF FAIRGROUNDS ROAD, SO FROM SANDY HOOK ROAD 5 22 TO MAINS ROAD, CARRIES 6,700 VEHICLES PER DAY.

V DOT'S CARRYING CAPACITY FOR THAT SECTION OF THE ROAD IS ABOUT 12,000 VEHICLES PER DAY.

SO WE'RE JUST A LITTLE BIT OVER HALF OF THE VDOT SAYS IS THE CARRYING CAPACITY OF THAT ROAD.

THIS PROJECT WILL GENERATE 400 VEHICLES PER DAY, WHICH IS A, THE IS 10 TRIPS PER LOT PER DAY.

UH, IS IS THE REQUIREMENT FOR THAT.

AND THAT COMES FROM THE INSTITUTE OF TRANSPORTATION ENGINEERS TRIP GENERATION MANUAL.

SOME OF THIS CAME UP IN THE PLANET COMMISSION, THAT'S WHY I'M EXPLAINING IT, WHICH IS BASED ON RECORDED TRIP DATA FOR OVER 30 YEARS.

SO THIS PROJECT WILL GENERATE ABOUT A 6% INCREASE INTO THE TRAFFIC ON FAIRGROUNDS.

ROAD TRAFFIC STUDIES TYPICALLY LOOK AT THE WORST TRAFFIC TIMES.

SO THE PEAK HOUR AND THE AM AND THE PM THE PROJECT WILL GENERATE 24 CARS IN THE AM AND 32 CARS AT, IN THE THE PM AT THE FAIRGROUNDS MAIDEN'S INTERSECTION.

THE CURRENT INTERSECTION CARRIES 989 CARS IN THE AM AND 1,199 CARS IN THE PM.

SO THE TRAFFIC FROM THE SUBDIVISION INCREASES THE PEAK HOUR TRAFFIC AT THAT INTERSECTION FROM THE SUBDIVISION INCREASES BY TWO TO 3%.

UH, BOTH REED MARSH AND RURAL HILL ACTUALLY ADD MORE TRAFFIC TO FAIRGROUNDS ROAD THAN THE VILLAGE AT HIDDEN ROCK.

AND IT'S MY OPINION THAT SINCE THE SUBDIVISION LIES ON FAIRGROUNDS ROAD, IT'S KIND OF BEARING A LOT OF THE BURDEN OF FAIRGROUNDS ROAD IMPROVEMENT BECAUSE OF THAT.

IS THAT, IS ITS ACCESS, UH, THIS INFORMA.

THE NEXT INFORMATION WE GOT FROM VI I COLLECTS COLLISION DATA.

AND THIS WAS THE COLLISION DATA FOR THE INTERSECTION OF FAIRGROUNDS ROAD IN MAIDENS.

AND SO SINCE 2015, SO SEVEN YEARS, THERE HAVE BEEN 10 COLLISIONS AT THAT INTERSECTION OR WITHIN A 200 FOOT DISTANCE FROM THAT INTERSECTION.

UH, 9,000 CARS PER DAY GO THROUGH THAT INTERSECTION.

SO THAT'S 3.3 MILLION CARS PER YEAR.

GO THROUGH THAT INTERSECTION.

IF YOU DO THE MATH, THIS COMES UP TO 0.45 COLLISIONS PER YEAR PER MILLION CARS.

VIDI HAS A THEY FLAG INTERSECTION OR THEIR KIND OF REQUIREMENT IF THEY DON'T CONSIDER IT A PROBLEM UNTIL THAT NUMBER HITS ONE COLLISION PER YEAR PER MILLION VEHICLES THROUGH THE INTERSECTION.

SO IT'S NOT EVEN HALFWAY THERE BEFORE VDOT WOULD FLAG THAT INTERSECTION AS A PROBLEM.

INTERSECTION.

UH, THIS SLIDE IS JUST KIND OF A BLOW UP OF SOME OF THE IMPROVEMENTS ALONG, UH, FAIRGROUND ROAD INTO THE SITE LEFT AND RIGHT TURN LANES.

SO WE'RE IMPROVING THE, THE ENTIRE FRONTAGE OF THE PROPERTY ALONG FAIR GROUND ROAD.

JUST WANNA SPEAK REAL QUICKLY ABOUT SOME OF THE BENEFITS TO THE COUNTY.

UH, QUALITY OF DEVELOPMENT IN THE COURTHOUSE VILLAGE, CLOSE TO THE SCHOOLS LIBRARY AND Y M C A DEVELOPMENT AND AREA DESIGNATED FOR GROWTH.

REDUCE URBAN SPRAWL INTO RURAL AREAS OF THE COUNTY, ADDED ROOFTOPS TO SUPPORT LOCAL BUSINESS.

WE PROFIT ELEVATIONS AND CONDITIONS TO ENSURE QUALITY OF DEVELOPMENT.

UH, EXTENSION AND CONNECTION TO PUBLIC WATER AND SEWER WOULD SHOW UP ON THE COUNTY MASTER UTILITY PLAN TO BE EXTENDED IN THE FUTURE.

UH, THE DEVELOPER AGREES TO PAY THE FULL CASH PROFFER AND AMOUNT OF $13,781, A LOT AS DETERMINED BY THE COUNTY CAPITAL GAINS, UH, CAPITAL IMPACTS MODEL, ASSUMING 40 HOMES CASH PROFFERS WILL TOTAL $551,240 TO BE LOCATED TO FUTURE ROADS,

BUT I DID IT A COUPLE DIFFERENT TIMES AND I WAS SIMILAR TO 25 TO 30 SECONDS.

SO THE TRAFFIC STUDY SAYS IN 2024, AT THAT TIME THAT YOU WOULD WAIT TO GET THROUGH THAT QUEUE WOULD BE 42 SECONDS.

WITH THE SUBDIVISION IT GOES TO 46 SECONDS.

SO INCREASES THAT TIME BY FOUR SECONDS.

VERY FEW TRIPS ARE TURNING THERE, THEY'RE GOING THROUGH THE INTERSECTION.

SO YOU'RE HAVING TO WAIT TO GET THAT BREAK IN THE TRAFFIC TO MAKE THAT MOVEMENT, WHICH ISN'T, WHICH INCREASES IT.

AND SO THE PRICE OF THESE HOUSES THAT ARE BEING PROPOSED DOES NOT BRING THAT IN LINE WHERE OUR FIRST RESPONDERS, OUR TEACHERS, OUR NURSES, OUR CORRECTIONAL OFFICERS THAT WORK HERE CAN AFFORD TO LIVE HERE.

AND THOSE ARE VERY IMPORTANT BECAUSE IF WE LOOK AT THE DEVELOPMENT THAT'S ALREADY DESIGNATED IN THE COUNTY AND IT'S ALREADY BEEN BROUGHT UP, THERE ARE 228 HOMES YOU'VE ALREADY APPROVED WITHIN THIS FEEDER SYSTEM FOR THIS ROAD.

SO WE'RE ALREADY 8,700 A DAY.

I DON'T REALLY CARE ABOUT THE LEVEL OF SERVICE THAT DOESN'T, I CAN, I CAN TAKE 10 MINUTES TO GO TO OILVILLE TO GET OUT TO SOMEWHERE GOING ONTO THE WEST END.

IT WAS MENTIONED, THE COMPREHENSIVE PLAN, WHICH WAS SUPPOSED TO BE FUTURISTIC, WAS SAYING THIS WOULD BE LOW DENSITY TWO ACRES PER LOT.

AND THIS IS UNUSUAL WHERE IT STARTED OUT LOWER DENSITY AND HAS NOW GOTTEN HIGHER DENSITY.

UM, I HAVE, I'LL SAY FOND RECALL OF, OF TUCKAHOE BRIDGE WHERE THERE HAD BEEN HIGH DENSITY THAT WENT DOWN TO LOW DENSITY BECAUSE IT WAS TRANSITIONAL IN THAT IT WAS MOVING FROM THE CORE OF A VILLAGE TO A MORE RURAL AREA.

AND I SEE SORT OF A REVERSE HERE, WHERE

WE'RE GOING FROM THE CORE AND THEN GOING TO HIGHER DENSITY.

UH, AT FIRST I THOUGHT MAYBE WE GRAINED SOME TRACTION WITH HIM AND HE WAS GONNA, YOU KNOW, COME OUR WAY WITH IT.

BUT HE SENT US AN EMAIL TODAY THAT HE TALKED TO SOME OF HIS, YOU KNOW, BOSSES OR HIGHER UPS AND THEY STILL DON'T LIKE THAT, UH, CONNECTION CUZ THEY'RE MULTIPLE PARCELS WITH MULTIPLE OWNERS AND THEY THINK THAT IT WOULD BE A, A, A HARD SELL.

HE DID PUT IN THERE THAT THE BOARD, IF THE BOARD DEEMS THAT, THAT IS, THOSE LAND USES AREN'T ACCEPTABLE WITH A COMP PLAN, THAT IT MAY BE SUFFICIENT JUSTIFICATION FOR A WAIVER.

SO MAYBE AS WE GO FORWARD, WE CAN, YOU KNOW, IF WE CAN GET THE BOARD TO, UH, STATE THAT OR AGREE TO THAT, I'M HAPPY TO SEND THIS EMAIL FROM VDOT, UM, THAT WE COULD POTENTIALLY GET A WAIVER IN PLACE AND GET THAT ROAD STUBBED BACK TOWARDS THE VILLAGE, WHICH IS WHAT WE HAD PROPOSED AT ONE TIME.

WHICH, UH, YOU KNOW, THERE'S STILL A SUBSTANTIAL PIECE OF LAND BETWEEN THIS PROPERTY IN HIDDEN ROCK PARK.

THE ISSUE THAT THEY HAVE HAD IS THAT THE LANDFILL IS THERE AND IT WOULD NEVER CONNECT BACK TO HIDDEN ROCK LANE, BUT THERE'S ROOM FOR ANOTHER ROAD BETWEEN THERE OR THERE'S STILL, YOU KNOW, QUITE A BIT OF PROPERTY IN THERE THAT IS IN THE VILLAGE THAT MAY BE DEVELOPED AT SOME POINT.

UH, THE OTHER THING I HEARD A BUNCH IS AFFORDABLE HOUSING.

I KNOW Y'ALL HEARD THAT A MILLION TIMES.

I DON'T EVEN KNOW WHAT AFFORDABLE HOUSING IS ANYWHERE.

UM, I THOUGHT REED MARSH WAS GONNA BE FOUR OR $500,000.

BUT AGAIN, I THINK YOU, IN YOUR PRESENTATION YOU SAID THIS DIDN'T CON IT DIDN'T CONTEMPLATE WATER AND SEWER BEING IN PLACE, BUT THE PLAN DOES SAY FOR WATER AND SEWER'S IN PLA IS IN PLACE, INFRASTRUCTURE'S IN PLACE, THEN IT JUSTIFIES MAKING THE DENSITY HIGHER.

THERE WAS THE EXPECTATION WITH THE PLAN THAT SHOULD, UM, UTILITIES BE PROVIDED IN THAT CASE, THE CAPACITY FOR SEWER WAS NOT AVAILABLE, UM, AT THE TIME OF THE PLAN AT THE TIME.

UM, AND AS YOU REFERENCE THE LEANS IN IT WITH A DIFFERENT, IT WAS, UM, VERY UNIQUE, UH, FLEX RESIDE, UH, FLEXIBLE WITH RESIDENTIAL.
