ORDINANCE SECTION 15 3 14 PLAN OF DEVELOPMENT AND 15 3 22 SUBDIVISION IMPROVEMENTS TO CHANGE WHEN SIDEWALKS AND STREET TREES NEED TO BE INSTALLED.

AND RESIDENTIAL DEVELOPMENTS TO DEFINE THE AREA TO BE DEPICTED ON PLANS OF DEVELOPMENT TO INCLUDE STANDARDS FOR THE INSTALLATION OF TEMPORARY SIGNS AND TO REQUIRE MAINTENANCE OF INSTALLED IMPROVEMENTS.

I'M JAMIE SHERRY, DIRECTOR OF COMMUNITY DEVELOPMENT.

AS MS. PARKER SAID, THIS IS A, UM, AMENDMENT TO THE COUNTY CODE IN ORDER TO ALLOW FOR, UM, UH, TIMING OF SUBDIVISION IMPROVEMENTS THAT IS MORE, THAT ARE GONNA BE MORE CONSISTENT WITH THE, UM, INDUSTRY STANDARDS, AS WELL AS, UM, PROVIDING A TIMELY MANNER OF, UH, OF THESE IMPROVEMENTS.

IN ADDITION TO SOME HOUSEKEEPING ITEMS, UM, THIS IS AN AMENDMENT THAT HAS BEEN INITIATED BY THE COUNTY, AND IT IS GOING TO BE AN AMENDMENT, UH, THAT WOULD BE BOTH FOR THE ZONING ORDINANCE AS WELL AS THE SUBDIVISION ORDINANCE.

SO THIS CAME ABOUT BECAUSE THE COMMUNITY, UM, DEVELOPMENT COMMUNITY HAD RAISED SOME CONCERNS REGARDING THE TIMING OF, UH, SO THE DIVISION IMPROVEMENTS.

CURRENTLY, THE WAY OUR ORDINANCE WORKS IS THAT, UM, AT 50% OF THE BUILDING PERMITS THAT ARE ISSUED FOR AN ENTIRE SECTION, ALL THE IMPROVEMENTS, UH, NEED TO BE MADE, MEANING LIKE SIDEWALK, UH, TREES, UM, UH, THE ROAD NEEDS TO BE,

UM, IMPROVED.

AND, UM, THEY HAVE, UH, EXPRESSED CONCERNS.

AND THIS HAS BEEN GOING ON FOR A COUPLE YEARS.

SOMEONE'S CONCERNS THAT AT THAT EARLY TIME, UM, AND DURING THE CONSTRUCTION TIMING, UM, UM, SIDEWALKS GET DAMAGED, SO DO LANDSCAPE, UM, AND MORE IMPORTANTLY THE ME THE ROAD.

UM, SO AS A RESULT, UM, STAFF WENT AND, UH, HAD, HAD DONE SOME RESEARCH AS FAR AS LIKE BENCHMARKING WHAT OTHER LOCALITIES ARE DOING, UM, AS WELL AS TOOK A DEEP DIVE INTO OUR ORDINANCES, AND THAT'S WHERE SOME OF THE, THE HOUSEKEEPING, UM, THE HOUSEKEEPING, UM, ITEMS COME FROM.

SO, UM, ADDITIONAL PROPOSALS, UM, OKAY, SO LET ME, LET ME, LET ME CIRCLE BACK.

THIS IS WHAT THE ORDINANCE IS ACTUALLY RECOMMENDING OR REQUESTING THAT INSTEAD OF AT, AT THAT 50% THAT I HAD MENTIONED, WE'RE GOING TO, UM, HAVE IT BE AT 80% OF THE LOTS, WHICH IS, UM, A SIGN THICK AND ENOUGH AMOUNT OF TIME TO, UM, ALLOW, UH, YOU KNOW, SOME MORE CONTROL OVER THE, OVER THE SITE AND HAVE LESS, UM, DAMAGE TO THE, UM, CONSTRUCTION IMPROVEMENTS.

UM, WE HAD BENCHMARKED A NUMBER OF COMMUNITIES, UM, IN THE SURROUNDING, UH, JURISDICTIONS, AND SOME OF THE JURISDICTIONS WERE A LITTLE BIT LOWER THAN 80%.

NONE WERE AS LOW AS 50.

WE WERE AT THE LOWEST.

UM, SOME WERE 70, SOME WERE EVEN AS HIGH AS 90 CHESTERFIELD AS HIGH AS 90.

SO WE, UM, SETTLED SOMEWHERE IN BETWEEN.

AND, UH, THIS HAS ACTUALLY BEEN SHARED WITH THE DEVELOPMENT COMMUNITY, AND WE'VE GOT POSITIVE FEEDBACK THUS FAR.

UM, IN ADDITION TO THE 80%, UH, THERE'S BEEN A COUPLE OTHER, UM, IMPROVEMENTS.

THERE'S SOME REQUIREMENTS THAT, UM, AT THAT 80% THE ROAD MUST BE ABLE TO BE ACCEPTED INTO THE STATEWIDE SYSTEM FOR PUBLIC ROADS, UM, AS WELL AS ALL OF THE IMPROVEMENTS TO BE MADE, UM, HAVE TO DO WITH, UM, 18 MONTHS AFTER THE, THE SUBDIVISION IS PLANTED AND NOT TWO YEARS, WHICH IT CURRENTLY IS.

IT'S A SIX MONTH TIME PERIOD, BUT THAT IS ENOUGH TO KIND OF GIVE US A LITTLE BIT MORE ASSURANCE THAT THOSE WILL IN FACT BE COMPLETED.

SO THAT MEANS LIKE IF A, IF SOMETHING IS PLATTED AND THE SUBDIVISION SETS, THEY STILL HAVE TO DO THOSE IMPROVEMENTS, EVEN THOUGH THEY'RE, THEY'RE NOT SELLING MANY, MANY LOTS THEY COULD HAVE, THAT WOULD MEAN THAT A HANDFUL OF FOLKS WOULD GET THE AMENITIES THAT THAT CAME WITH THEIR, THEIR NEIGHBORHOODS.

SO A COUPLE OF HOUSEKEEPING, UH, CHANGES.

UH, WE DID UPDATE THE BOND REDUCTION, UH, RELEASE STANDARDS AND OUR SUBDIVISION JUST TO BE CONSISTENT WITH, UH, UM, STATE CODE.

UH, WE IMPROVED, UH, STANDARDS FOR TEMPORARY SUBDIVISION SIGNS.

THEY'RE MORE DURABLE NOW.

THEY HAVE TO FACE A CERTAIN WAY.

OUR, OURS WAS A LITTLE BIT LOOSEY GOOSEY.

NOW WE HAVE SOMETHING TO ACTUALLY HOLD THE DEVELOPERS ACCOUNTABLE FOR, UH, FOUR INCH, UM, FOUR INCH LETTERING REFLECTIVE, WHICH IS CONSISTENT WITH WHAT WE WOULD REQUIRE FOR A REAL SIGN.

UM, IT CLARIFIES THAT ANY DEVELOPMENT BE CONSTRUCTED OR ANY, UH, LAND DISTURBANCE HAPPEN IN ACCORDANCE WITH AN APPROVED PLAN.

YOU CAN'T JUST GO ROGUE.

UM, THIS ACTUALLY JUST CLARIFIES AND STATES THAT IN THE ORDINANCE.

UM, AND IT ALSO REQUIRES SUBDIVISION P ODS TO BE INCLUDE, TO INCLUDE ALL AREAS SHOWN ON A SUBDIVISION FINAL PLAT.

SO IT SHOWS THE PLAT AND NOT AREAS OUTSIDE OF IT.

THIS IS A HOUSEKEEPING, UM, ITEM.

UM, WE HAVE ENCOUNTERED A LITTLE BIT OF THAT, BUT UH, IS NOT REGULAR.

UH, SO STAFF COMMENTS.

UM, IN ADDITION TO MAKING THE TIMING OF THE SUBDIVISION IMPROVEMENTS MORE CONSISTENT WITH INDUSTRY STANDARDS, IT WILL ALSO ENSURE THE COMPLETION IN A TIMELY MANNER OF THESE IMPROVEMENTS INCREASE, INCREASE THE SAFETY OF RESIDENTS.

FOR EXAMPLE, IF YOU LIVE IN A SUBDIVISION, YOU WOULD LIKE TO WALK SAFELY TO GET YOUR MAIL, SO THEREFORE THE REQUIREMENT FOR THOSE TO BE COMPLETED.

UM, AND THEN IT ALSO MINIMIZES THE INFRASTRUCTURE PROBLEMS THAT DEVELOPMENT COMMUNITY BROUGHT TO OUR ATTENTION.

THAT IS VERY, VERY, VERY QUICK VERSION OF, OF THESE, UH, CHANGES.

BUT I'D BE HAPPY TO ANSWER ANY QUESTIONS.

HAVE A QUICK QUESTION.

YES, SIR.

UM, ON THAT SLIDE THAT SAID, ARE YOU EITHER 50% OF LOTS OR 80% OF LOTS? MM-HMM.

TALKING ABOUT WHEN THE LOTS ARE SOLD OR WHEN THE LOTS ARE ACTUALLY, WHEN SOMETHING IS ACTUALLY BUILT ON THEM? THAT'S KIND OF CONFUSING.

SO IT'S ACTUALLY THE ISSUANCE OF BUILDING PERMITS.

SO IF, FOR EXAMPLE, IF, IF A SUBDIVISION, UM, HAD SOLD A BUNCH OF, UH, LOTS AND WE'RE, WE'RE GETTING A BUNCH OF BUILDING PERMITS AT THE SAME TIMES ONCE THEY HIT THAT 50TH, AS OF RIGHT NOW NO MORE UNTIL ALL THE IMPROVEMENTS ARE PUT IN 50 PERCENTILE.

SO AGAIN, IT DEPENDS ON HOW LARGE THE SECTION OF THE SUBDIVISION IS AS TO HOW MANY HOUSES THAT ACTUALLY WOULD BE.

SO NOW WE'RE MOVING IT TO 80, SO IT GIVES THEM A LITTLE BIT MORE TIME TO BUILD OUT AND NOT HAVE TO DAMAGE THE ROAD, THE LANDSCAPING AND THE SIDEWALKS.

OKAY, SO IT'S WHEN IT'S PERMITTED, NOT WHEN THEY'RE

OCCUPIED, CORRECT.

WELL, WHAT'S THE KEEP, WHAT'S THE, UH, KEEP 'EM FROM GETTING A PERMIT AND SITTING ON A PERMIT FOR A LONG TIME? WELL, WE DO HAVE A REQUIREMENT THAT ANY PERMIT THAT'S ISSUED DOES HAVE TO HAVE SOME SORT OF ACTIVITY ON IT EVERY SIX MONTHS.

UM, YOU KNOW, THAT VARIES AS TO WHAT THAT, WHAT THAT ACTUALLY MEANS, BUT YEAH.

OKAY.

IS WHEN THAT SAME PAGE WHERE IT SAYS FROM TWO YEARS TO 18 MONTHS MM-HMM.

, THAT, THAT, THAT SAYING THAT THE SUBDIVISION, BY CHANCE IT SETS I LIKE A LOT OF STUFF IN EIGHT, THEY STILL HAVE TO DO THESE IMPROVEMENTS.

YES.

IN 18 MONTHS.

IN, IN 18 MONTHS, THAT IS CORRECT.

THAT WAS MET WITH OPEN ARMS BY THE YEAH, THEY'VE REVIEWED IT AND, UH, I, WELL, I, I, I HAVE GOTTEN, UH, I DO KNOW THAT WE DID RECEIVE, UH, THROUGH THE PLANNING COMMISSION, UM, ONE EMAIL OF SUPPORT.

UM, I, UM, HAVE NOT PERSONALLY RECEIVED ANY, ANYTHING OTHER THAN CONVERSATIONS, ANY OTHER DISCUSSION.

THIS NEXT ORDINANCE AMENDMENT WOULD BE FOR THE, UM, ZONING ORDINANCE ONLY IN REFERENCE TO THE HEIGHT REQUIREMENTS FOR THE INDUSTRIAL GENERAL M TWO ZONING DISTRICT.

UM, THIS IS ANOTHER COUNTY INITIATED, UM, ORDINANCE AMENDMENT REQUEST.

SO ESSENTIALLY, UM, IF YOU HAVE A BUILDING THAT IS 60 FEET, UM, FOR STRUCTURES WITHOUT, UH, SPRINKLER SYSTEMS, UM, UH, 60 FEET IS THE MAXIMUM HEIGHT.

IF WITH SPRINKLER SYSTEMS IT'S 80 FEET.

UM, THIS IS CLARIFICATION THAT ANYTHING OVER 80 COULD BE APPROVED, UH, THROUGH A CONDITIONAL USE PERMIT.

HERE'S THE ACTUAL, UM, ORDINANCE TEXT.

AS YOU CAN SEE, THERE IS LANGUAGE IN REFERENCE TO, UM, THE C U P, BUT IT'S IN THE LINE THAT HAS THE 80 FEET.

BY MOVING IT TO THE NEXT LINE FOR THE C P DOES ACTUALLY CLARIFY THAT ANYTHING OTHER THAN WHAT HAS BEEN PRESENTED, UM, COULD BE APPROVED WITH A CONDITIONING USE PERMIT.

UM, THIS WOULD BE ALLOWED WITH A CONDITIONAL USE PERMIT AND BOTH DISTRICTS, AND THEY WOULD ALSO HAVE TO HAVE, UM, UM, ABIDE TO THE USE STANDARDS.

ONCE AGAIN, THIS IS A COUNTY INITIATED ORDINANCE AMENDMENT.

SO, UM, JUST A LITTLE BIT OF BACKGROUND.

UM, THERE IS, UM, UH, A NEED BASED ON CONVERSATIONS WITH ECONOMIC DEVELOPMENT TO SUPPORT THE SMALL BUSINESSES.

UM, AS BUSINESSES GROW, UM, THEY, THEIR, THEIR, THEIR STUFF GO GROWS AS WELL.

AND THIS IS PARTICULARLY, UM, RELATED TO HOME OCCUPATIONS.

RATHER THAN STORING A BUNCH OF STUFF AT THE HOUSES, GIVES PEOPLE THE OPPORTUNITY TO HAVE A, UM, A SMALL STORAGE BUILDING WITHOUT HAVING TO GO TO A COMMERCIAL SPACE THAT IS, WOULD, WOULD NOT REALLY NECESSARILY ALLOW THEM TO GROW AT THE RATE THAT THEY WOULD, UH, MORE NATURALLY GROW.

UH, SO, UM, THE ORDINANCE DOES DEF DEFINE A CONTRACTOR STORAGE SMALL AS A STORAGE OF CONTRACTOR SUPPLIES AND EQUIPMENT WITH A BUILDING OF NOT MORE THAN 2,500 SQUARE FEET.

SO, UM, THAT IS WHAT BASICALLY DEFINES THE SIZE OF THE BUILDING.

THERE ARE USE STANDARDS THAT WOULD ALSO GO ALONG WITH THAT.

UM, THE FIRST ONE IS A THREE ACRE MINIMUM.

UH, FOR THE LOT SIZE, THERE WOULD ONLY BE ALLOWED ONE STORAGE BUILDING ON THE PARCEL.

NO CUSTOMERS OR EMPLOYEES, UM, OR NON-EMPLOYEES.

THE GENERAL PUBLIC COULD NOT COME TO THE SITE FOR NO REASON.

UM, BUILDING SETBACKS WOULD BE A HUNDRED FEET FROM ANY PROPERTY LINE.

THERE WOULD BE REQUIRED SCREENING OF THE BUILDING AND PARKING.

UH, THE SCREENING COULD BE MADE UP OF, UM, DENSE VEGETATION.

UM, POSSIBLY SOME FENCING OR A COMBINATION OF BOTH.

UH, THERE'S NO OUT OUTSIDE STORAGE ALLOWED WITH THIS USE.

UH, VEHICLES, THERE'S A LIMITATION ON THE NUMBER AND TYPE OF VEHICLES.
