UM, OUR FIRST PUBLIC HEARING TONIGHT IS FOR A CONDITIONAL USE PERMIT, UH, APPLICATION BY MAR MARVIN AND TAMLIN HOWELL.
UH, THE PROPERTY IS LOCATED ON ART ROAD AND IT IS A REQUEST FOR AN ACCESSORY FAMILY HOUSING UT UNIT DETACHED.
UM, AS YOU CAN SEE FROM THE AERIAL, UM, WHERE YOU CAN SEE WHERE THE LOCATION OF THE, UM, PROPERTY IS, IT'S IN THE, GENERALLY IN THE EASTERN PORTION OF THE COUNTY.
UM, IT IS LOCATED AT THE INTERSECTION OF HERMITAGE ROAD AND ART ROAD.
THE ADDRESS IS ACTUALLY AN, AN ART ROAD ADDRESS OF WHERE THEY ACTUALLY ACCESS THE PROPERTY.
THE PROPERTY AND ALL THE SURROUNDING PROPERTIES ARE, UM, ZONED AGRICULTURAL LIMITED AS, UH, THE COMPREHENSIVE PLAN DESIGNATION FOR THIS AREA IS SINGLE FAMILY RESIDENTIAL LOW DENSITY.
THIS IS FOR THE SUBJECT PROPERTY AS WELL AS ALL THE SURROUNDING PROPERTIES AROUND IT.
UM, SO ON THE RIGHT HAND SIDE IS I'VE BLOWN UP THE, UM, CON, UM, CONCEPTUAL PLAN THAT WAS PART OF THE APPLICATION IN YOUR PACKET AND MARKED IT UP A LITTLE BIT JUST FOR, UM, FOR, UM, SO YOU CAN SEE WHAT IT IS.
UH, CURRENTLY ON THE PROPERTY, THERE ARE TWO EXISTING DWELLINGS.
UH, THE FIRST ONE IS IN THE GREEN CIRCLE AND THE SECOND ONE WAS, IS IN THE RED CIRCLE.
UH, THE ONE IN THE RED IS, UH, 1400 SQUARE FEET AND WAS BUILT IN THE 1970S.
THAT ONE WILL REMAIN ON THE PROPERTY.
THE ONE IN THE GREEN IS AN OLDER HOUSE THAT IS CURRENTLY

THAT'S THE LOCATION OF THE NEW, UH, SO THEY WILL BE, UM, DEMOLISHING THE HOUSE IN THE FRONT AND PLACING IT BEHIND IT.

SO THIS WOULD BE CONSISTENT WITH THE COMP PLAN.
THERE WAS A MEETING BACK IN OCTOBER, UH, TWO COMMUNITY MEMBERS DID ATTEND.
UM, BOTH OF THEM DID EXPRESS SUPPORT.
I'M GONNA GO THROUGH THE STANDARDS.
THEY'RE, I MEAN, THE CONDITIONS ARE JUST OUR STANDARD CONDITIONS WITH A FIVE YEAR RENEWAL.
SO, UM, THEY ARE ALLOWED, UH, BY NUMBER ONE TO HAVE A DETACHED ACCESSORY FAMILY HOUSING UNIT.
UM, THE NUMBER TWO, IT WOULD BE LIMITED TO FAMILY, UM, AND THE PRINCIPAL DWELLING AS WELL.
AND THE, UM, ACCESSORY DWELLING, THEY WOULD HAVE TO BE RELATED.
UM, THEY WOULD NOT BE ABLE TO RENT EITHER OF THEM INDEPENDENTLY.
IF THEY WERE TO RENT ONE OF THEM.
IT WOULD HAVE TO BE, UM, SOMEONE THAT IS RELATED AND ONLY ONE RENT, UM, FOR THE ENTIRE PROPERTY.
UM, THE SITE PLAN THAT I SHOWED YOU, GENERAL CONFORMANCE TO, UM, HOW, HOW IT WAS PRESENTED, UH, THE DEMOLITION.
SO THEY WOULD BE REQUIRED TO GET A DEMOLITION PERMIT, UM, SO THAT WE ARE SURE THAT IT DOES ACTUALLY GET DISPOSED OF PROPERLY.
UM, THEY WOULD BE REQUIRED TO HAVE CARBON MONOXIDE DETECTORS AND SMOKE DETECTORS AND TO MAINTAIN THEM, UM, THE ACCESS TO THE PROPERTY WOULD HAVE TO BE MAINTAINED.
UH, SO THAT FIRE ACCESS WOULD BE, UM, ACHIEVED, WHICH IT CURRENTLY IS.
UH, THERE IS A FIVE-YEAR EXPIRATION ON THIS.
I HAD MENTIONED IT WOULD, UM, EXPIRE IN JANUARY 20, 29.
AND THE LAST IS OUR, UH, OUR STANDARD TRANSFER OF OWNERSHIP.
MEANING IF THEY WERE TO EITHER LEASE THE PROPERTY TO SOMEONE ELSE OR SELL THE PROPERTY TO SOMEONE ELSE, THEY WOULD NOT ONLY HAVE TO SHARE THE CONDITIONS WITH THEM, THEY WOULD ALSO HAVE TO NOTIFY THE COUNTY.

I THINK THE THOUGHT AND THEORY OF THE, UM, FOR THESE PARTICULAR CASES, LIKE NOT THAT I'M EXPECTING THE HOUSE TO MOVE.
I THINK THEY HAVE INVESTED MANY, MANY YEARS IN THIS PROPERTY AND I THINK THEY INTEND TO, BUT IF SOMEBODY WASN'T AND THEY WERE TO MOVE ON AND THAT LAST CONDITION WASN'T, UM, ACTUALLY FOLLOWED THROUGH, THAT WOULD BE ONE WAY WE WOULD KNOW.
YOU KNOW, IF WE, IF WE, YOU KNOW, THEY HAD TO COME BACK FOR RENEWAL AND THEY WERE LIKE, OH, WE SOLD THE PROPERTY, YOU KNOW, THAT WOULD BE AN OPPORTUNITY FOR US TO, UM, TO REVISIT IT.

SO I GUESS THE PRECEDENT IS WE HAVE FIVE YEARS AND IF, IF THE HOWELLS DECIDE TO SELL THE PROPERTY, IT, THERE'S SOME LITTLE, A LITTLE BIT OF PROTECTION IN, FOR THE COUNTY, FOR THE COUNTY NEIGHBORS ENFORCEMENT.
I MEAN THAT'S KIND OF WHAT WE'RE THINKING, BUT RIGHT.
BUT IT'S NON TRANSFERRABLE ANYWAY.
