UM, IT IS A CONTRACTING BUSINESS THAT DOES WORK, UM, THROUGHOUT THE STATE, BUT DOES NOT PERFORM THE BUSINESS OPERATIONS ON SITE FOR THE PRIMARY BUSINESS. THE ONLY OPERATIONS THAT ARE ON SITE THAT ARE LISTED HERE ARE LIMITED TO THE BUSINESS OFFICE AND THE VEHICLE AND EQUIPMENT STORAGE RELATED TO THE BUSINESS. THE GREEN AREA HERE IS CURRENTLY THE PRINCIPAL DWELLING UNIT ON THE SITE, BUT IT WILL BECOME THE ACCESSORY DWELLING UNIT ON SITE. ONCE THE BUILDING OUTLINED IN BLUE IS CONSTRUCTED, THAT WILL BECOME THE PRINCIPAL UNIT THAT THE APPLICANT WILL LIVE IN. THE OTHER WILL BE AN ACCESSORY UNIT FOR FAMILY MEMBERS CAN STAY IN. UM, YOU SEE AN EXISTING FOUNDATION OUTLINE FOR THE BLUE THERE. THAT IS AN OLDER FOUNDA, THE FOUNDATION THAT WAS PREVIOUSLY STARTED. THIS IS AN AGRICULTURAL PIECE OF PROPERTY. YOU ARE PERMITTED TO DO FARMING OPERATIONS. AMONG THAT, UM, THE APPLICANT DOES HAVE CHICKENS, UH, UH, CATTLE AND OTHER TYPES OF FARMING RELATED BUSINESSES. THE REASON I PROVIDE THIS IS TO DEMONSTRATE THERE ARE BUFFERS THAT EXIST ADJACENT TO THE APPLICANT'S PROPERTY. UM, SPECIFICALLY THERE'S A 75 FOOT BUFFER TO THE NORTH. THERE'S A 50 FOOT BUFFER WITH A BERM. AND I OUTLINE THE OTHER GENERAL BUFFERS FOR THIS PROPERTY. THERE IS A 35 FOOT BUFFER ADJACENT TO OTHER PROPERTIES IN THE AREA. UH, SPECIFICALLY FOR THIS PROPERTY. THE CONDITIONS OF THIS CASE AND AN ORIGINAL AGREEMENT OF THE SONGBIRD DEVELOPMENT IS THAT THE BUSINESS OPERATIONS WILL NEED TO ACCESS VIA SONGBIRD LIEN. THERE IS A PROPOSED STUB ROAD, UM, THAT WAS REQUIRED WITH THE SONGBIRD DEVELOPMENT. THE BUSINESS WOULD NOT BE PERMITTED, UM, TO UTILIZE THAT STU ROAD SHOULD IT BE CONSTRUCTED AS REFERENCED. IT MEANS THAT YOU HAVE SINGLE FAMILY RESIDENTIAL USES WITH AN AVERAGE LOT SIZE OF, UH, TWO ACRES [00:10:01] WITH PROPER CONDITIONS. PROPOSAL WOULD COMPLY WITH THE COMPREHENSIVE PLAN. AGRICULTURAL PROPERTIES AND FARMING USES ARE COMMON WITHIN THIS COMPREHENSIVE PLAN AREA. THE REAL CHARACTER OF THE PROPERTY IS MAINTAINED, UH, WITH THE FARMING USES AND THE LIMITATIONS ON THE BUSINESS. THE HOME-BASED BUSINESS INCLUDES, INCLUDES, UM, IMPOSED CONDITIONS TO MITIGATE IMPACTS. THERE ARE TWO DWELLING UNITS PROPOSED ON THIS PROPERTY. HOWEVER, THE RESULTING DENSITY, UM, FROM THIS WOULD BE LESS THAN WHAT IS RECOMMENDING THE COMPREHEN COMPREHENSIVE PLAN OR WHAT IS DEVELOPED OR PROVIDED THROUGH ZONING ON NEARBY PROPERTIES. UH, THE QUESTIONS FROM THE ATTENDEES REALLY RELATED TO WHAT'S THE USE OF THE PROPERTY. THEY WANTED TO UNDERSTAND THE BUSINESS, WHAT'S INTENDED WITH THE USE OF THE BUSINESS, WHETHER THIS ACTION ACTUALLY REZONED THE PROPERTY TO COMMERCIAL, WHICH IT DID NOT, AND IF THE APPLICANT WOULD BE SEEKING SHORT-TERM RENTAL OF THE DWELLING UNITS ON THE PROPERTY. WE HAVE ALSO RECEIVED CITIZEN COMMENTS THROUGH EMAILS AS WELL AS, UM, DISCUSSIONS, UH, WITH SOME OF THE PEOPLE SENDING EMAILS. AND THE COMMENTS RELATED TO SPECIFICALLY A REQUEST FOR ADDITIONAL BUFFERS ALONG THE SUBJECT PROPERTY LINES, UH, REQUEST FOR A BOARD FENCE TO BE PROVIDED ALONG THE NORTHERN PROPERTY LINE TO SCREEN THE USE FROM THE ADJACENT DEVELOPMENT OF SONGBIRD AND PREVENT TRESPASS. UH, THERE WAS ALSO A REQUEST FOR CONDITIONS TO BE IMPOSED REGARDING CLEANUP OF DEBRIS OR MATERIALS RESULTING FROM THE BUSINESS USE ON SONGBIRD LANE. AGAIN, SONGBIRD LANE IS THE, THE PRIMARY ACCESS. IT WILL BE A PUBLIC ROAD, UM, AND THE BUS, THIS BUSINESS, UM, POTENTIALLY MAY USE THAT. THERE IS AN ACCESSORY FAMILY GEL UNIT REQUEST. AS WE OUTLINED BEFORE. THERE IS A LIMITATION RELATED TO THE VIS VEHICLES AND TYPE AND NUMBER THAT ARE AVAILABLE OR MAY BE PERMITTED ON THE PROPERTY. THE BUSINESS RELATED PARKING, UH, MAY NOT BE PERMITTED WITHIN 35 FEET OF A PROPERTY LINE. SHOULD THE BUSINESS WISH TO UTILIZE SIGNAGE, IT WOULD BE LIMITED TO NO MORE THAN NINE SQUARE FEET. WHAT I'VE DONE HERE, AND I'LL WALK YOU THROUGH THE CHANGES, IS TO ALSO TO UPDATE THAT CHANGE AND TO NOTE THAT THERE WOULD BE A DISTINCT THERE WOULD BE A DIFFERENCE BETWEEN EXPIRATIONS BETWEEN THE TWO REQUESTS. IN OCTOBER, UH, UM, OCTOBER OF THIS YEAR, UH, THE APPLICANT INVITED HER NEIGHBORS TO COME TO THE PROPERTY TO HEAR ANY OF THEIR CONCERNS. AND AT THAT TIME, 11 NEIGHBORS SHOWED UP AS WELL AS SUPERVISOR WINFREY AND SUPERVISOR SPOON HOWER. UH, SUBJECTS THAT THAT WERE DISCUSSED INCLUDE THE PROPOSED LOCATION OF THE USES, UH, THE MUSIC ASSOCIATED WITH A PRIVATE WEDDING THAT WAS HELD ON THE PROPERTY JUST BEFORE THE MEETING, THE LOCATION OF THE ENTRANCE TO THE PROPOSED VENUE AND THE POTENTIAL IMPACT IT COULD HAVE TO THE RESIDENTIAL PROPERTY ACROSS RIVER ROAD WEST FROM THE SUBJECT PROPERTY. THERE HAS BEEN OTHER COMMUNITY INPUT. UM, I MENTIONED THAT THE APPLICANT DID HOLD A COMMUNITY MEETING. THIS CAME AS A RESULT, UM, ON THEIR OWN. THIS CAME AS A RESULT OF A MEETING THAT WAS HELD PRIOR TO THE SEPTEMBER 19TH, UH, PLANNING MEETING THAT WAS SCHEDULED. AREA NEIGHBORS CONTACTED, UM, MR. WINFREY, THE DISTRICT THREE BOARD SUPERVISOR AND REQUESTED A MEETING WITH HIM AND STAFF. UM, IN ATTENDANCE WERE, UM, MR. WINFREY, UM, MR. AND SHORT-TERM RENTAL CONCERNS WERE RELATED TO THE NUMBER OF EVENTS. LOUD MUSIC HEARD AT PRIVATE EVENTS, USE OF THE, OF THE PRIVATE SHOOTING RANGE ON THE PROPERTY AND SHORT-TERM RENTALS WITHOUT HAVING A CONDITIONAL USE PERMIT. STAFF ALSO RECEIVED FOUR EMAILS IN SUPPORT OF THIS APPLICATION. SO WITH THE COMPO, WITH THE IMPOSED CONDITIONS TO INCLUDE LIMITING THE NUMBER OF EVENTS, LIMITING THE NUMBER OF GUESTS, HOURS OF OPERATION, AND SH SHORTENING THE DURATION OF THE EXPIRATION DATE. THIS USE IS CONSISTENT WITH COMPREHENSIVE PLAN. THERE WERE SOME CODE ENFORCEMENT ISSUES THAT I WOULD LIKE TO MAKE YOU AWARE OF. UH, THE SHORT-TERM RENTAL USE AT THE TIME OF APPLYING FOR THE CONDITIONAL USE PERMIT, THE A APPLICANTS WERE OPERATING TWO UNHOSTED SHORT-TERM RENTALS, THE ONES THAT THEY'RE ASKING FOR, UM, THE PERMIT TO, TO HAVE NOW. BUT WHEN THE APPLICANT, UM, THE APPLICANT ACTUALLY DID STOP USING THE SHORT TERM RENTALS AND STOPPED BOOKING 'EM. AND THEY HAVE COMMITTED TO THAT UNTIL IF THIS, UM, REQUEST IS APPROVED. UM, THE APPLICANT'S ALSO PLACED A PREFAB PREFABRICATED SHED TO HOLD FARMING EQUIPMENT ON THE PROPERTY WITHOUT A ZONING PERMIT. UM, ONCE STAFF BECAME AWARE OF THIS, UM, IT, WE DID SOME RESEARCH AND FOUND THAT THAT IS ACTUALLY LOCATED WITHIN THE FLOODPLAIN AREA AND ALTHOUGH IT IS ALLOWED IN THE FLOODPLAIN, IT WOULD REQUIRE A CONDITIONAL USE TO, UM, BE PERMITTED. UM, IT IS A VERY CHARMING PROPERTY AND WE KNEW THAT IF WE TOOK IT ON, WE WERE GONNA HAVE TO GET VERY CREATIVE. IT IS VERY LARGE. WE'RE SITTING ON ABOUT 130 ACRES OF LAND. UM, WE, WE ARE SURROUNDED BY FARMING. AND IN THE CENTER OF THE FARM IS THIS BEAUTIFUL, BEAUTIFUL, HISTORIC HOME. UM, IT HAS A LOT OF HISTORY WITH GLAND. A LOT OF PEOPLE THAT I COME ACROSS ON A DAILY BASIS HAVE LIVED THERE, WORKED THERE, HAVE SOME SORT OF STORY GOING BACK TO MOUNT BERNARD. SO WE WANTED TO KEEP THAT GOING. WE WANNA PRESERVE THE LAND. WE WANTED TO KEEP THE FARMING, WE WANTED TO, UH, TEACH OUR CHILDREN THOSE VALUES. AND SO WE DID SAY WE HAVE TO, WE DO HAVE TO GET CREATIVE WITH THIS, [00:55:02] UM, BECAUSE FARMING DOES COST QUITE A LOT OF MONEY. UH, CURRENTLY, UH, ON OUR WESTERN SIDE, WE'RE, WE'RE UP AGAINST THE ESTATE OF RIVER RUN. I GO BACK 'CAUSE IT'S PRETTIER PICTURES, BUT UP AGAINST THE STATE OF RIVER RUN IS WHERE WE DO ALL OF OUR HORSE BOARDING. WE HAVE PASTURES ALMOST ALL ALONG THEIR, UH, DRIVEWAY LINE, UM, HEADING BACK DOWN THE ROAD TO THE RIVER. TOWARDS THE STATE OF RIVER RUN IS OUR HAY PROPERTY WHERE WE HARVEST HAY. WE WERE POLITELY ASKED TO TAKE IT DOWN. UM, I THINK THE CONCERN WAS IT BEING TOO CLOSE TO ROUTE SIX AND ALSO MAYBE TAKING AWAY THE VALUE OF THE HISTORICAL SETTINGS AROUND US. BUT IT WAS A REALLY FUN FARM STAND. WE HAD A LOT OF FUN WITH THAT, AND WE HOPE TO HAVE SOMETHING BACK UP WHERE WE CAN STILL SHARE WITH OUR NEIGHBORS. IT WAS A GREAT WAY TO MEET NEIGHBORS AS WELL. UM, SO FARMING, AS MOST OF YOU KNOW, IT IS QUITE THE ORDEAL. AND AS A SMALL FARMER, THE COSTS ARE PRETTY SIGNIFICANT. UM, MACHINERY, TRACTORS, ACCESSORIES, FUEL. I MEAN, THIS IS EXPENSIVE. IT GETS EXPENSIVE. WHEN WE GOT TO MOUNT BERNARD FARM, WE HAD TO REPLACE ALMOST ALL THE FENCE SAND, AND WE HAVE TONS OF PASTURES, YOU KNOW, ALL SET UP TO BOARD HORSES AND TO MAINTAIN CATTLE. UM, THE FARM STRUCTURES ARE JUST LIKE THE HISTORIC HOME ARE PRETTY OLD. SO THEY'VE, UH, THEY'RE FALLING APART. SO WE'RE HAVING TO FIX THOSE UP. UH, PASTURES WERE IN POOR QUALITY. WE'VE HAD TO RECEDE, WE'VE HAD TO FERTILIZE LIME. THERE'S A LOT OF LABOR THAT GOES INTO HARVESTING THE CROPS. WE DO OUR OWN HAY. WE SELL OUR OWN HAY. UM, AND THEN YOU'VE GOT THE ANIMALS TO TAKE CARE OF AND THE FEED. SO THOSE THAT HAVE A FARM OR A SMALL FARM, YOU KNOW, THE COSTS ARE SIGNIFICANT. WE HAD TWO SMALL HOMES ON THE FARM THAT WERE RENTALS BEFORE. UH, WE DECIDED TO DO THE SHORT TERM RENTALS WITH THEM. I'M ALSO CONCERNED ABOUT THE LACK OF THE TRAFFIC STUDY PROVISION WITH THIS CONDITIONAL USE PERMIT AS WAS REQUIRED FOR BOTH THE ESTATE AT RIVER RUN AND DOVER HALL. THIS PROVISION ENSURED THAT TRAFFIC WAS NOT IMPACTED ONE YEAR AFTER BUSINESS OPERATION. AS SOMEONE WHO DRIVES ROUTE SIX DAILY, THIS ISSUE WOULD IMPACT THE MOST RESIDENTS, UM, AND THE GREATEST PROPORTION.
