UM, WE COME BEFORE YOU AGAIN AT THIS MEETING THANKING YOU THAT WE STILL CAN CALL ON YOU AND WANT TO AT A MEETING SUCH AS THIS.

AND, UM, WITH ALL THE CRAZY THINGS GOING ON IN THIS WORLD, WE NEVER KNOW FROM DAY TO DAY WHAT'S GONNA HAPPEN NEXT.

AND SOMETIMES WE CAN FEEL SO OUT OF CONTROL FOR THOSE THINGS.

UM, YET YOU ARE GOD IN HEAVEN.

AND THE THINGS OF THIS WORLD SEEM SMALL TO YOU, THOUGH CERTAINLY NOT UNIMPORTANT.

AND SO NOW WE BOW BEFORE YOU IN THIS PART OF VIRGINIA, THIS GLAND BORDERS BOARD OF SUPERVISORS AND THEIR PRAYER, AND I'M SO HAPPY TO HEAR THEY WANT TO DO THIS, BUT THEIR PRAYER IS THAT, AND, AND MINE FOR THEM WOULD BE THAT YOU WOULD GIVE THEM THE WISDOM AND UNDERSTANDING.

THEY NEED TO HANDLE THE SOMETIMES ROUTINE THINGS THAT COME UP, AND SOMETIMES CREATIVE NEW THINGS THAT MAY COME UP.

AND WE PRAY FOR A SENSE OF JUSTICE AS THEY DO THAT.

AND, UM, WE COMMIT THIS DAY TO YOU.

WE COMMIT THIS TIME TO YOU AND PRAY THAT YOU WILL BLESS IT SO THAT, UM, IN THE END, WE CAN LOOK UP AND SAY, THIS IS THE MOST WORTHWHILE EFFORT TO CALL ON YOUR NAME.

UH, IT'S MY PRIVILEGE AND PLEASURE TODAY TO INTRODUCE TO, UH, YOU THE BOARD AND TO THE CITIZENS OF UCHIN COUNTY.

MR. TOBY FRITZ.

TOBY IS THE NEW EXECUTIVE DIRECTOR OF THE UCHIN PALIN COMMUNITY SERVICES BOARD, WHICH PROVIDES THE SERVICES FOR MENTAL HEALTH, DEVELOPMENTAL DISABILITIES, AND SUBSTANCE ABUSE.

MR. FRITZ, IF YOU'D LIKE TO SAY A FEW WORDS TO THE BOARD.

GOOD AFTERNOON, EVERYONE.

UM, SO MY NAME'S TOBY.

I JUST AM MOVING TO THE AREA.

I'M VERY EXCITED TO BE HERE.

JUST A, A LITTLE BIT ABOUT ME.

I'VE GOT THREE DECADES IN, IN THE FIELD, UM, BUT NEW TO THE CSB SYSTEM.

SO AS, UM, I, I GET UP TO SPEED.

THE ONE OF THE THINGS I'M DOING IS JUST REALLY TRYING TO ENGAGE THE COMMUNITY AND GET TO KNOW FOLKS.

AND, AND PART OF THAT IS REACHING OUT TODAY AS YOU, IF YOU HAVE ANY FEEDBACK FOR ME, I'D LIKE YOU TO REACH OUT AND, AND, YOU KNOW, GIVE ME FURTHER.

WE CAN TALK ONE-ON-ONE A LITTLE BIT FURTHER.

AND JUST IN TERMS OF WHAT YOU SEE AS FAR AS NEEDS IN THE COMMUNITY, JUST VERY EXCITED TO, TO TACKLE THAT.

UM, OVER THE FIRST SIX MONTHS, I'M GONNA BE WORKING ON A STRATEGIC PLAN TO, TO BETTER SERVE THE COMMUNITY AND, AND STRENGTHEN WHAT WE DO.

DO THIS FOLLOWING PRESENTATION OF A RESOLUTION, RECOGNIZING GOLAND ROTARY ON ITS 30TH ANNIVERSARY.

AND MY FELLOW BOARD MEMBER AND FELLOW ROTARIAN, JONATHAN LYLE, WILL JOIN US.

AND WE HAVE THE PRESIDENT OF THE ROTARY CLUB WITH US, MR. JOHN AARON.

WHEREAS IT IS THE DESIRE OF THE GLAND COUNTY BOARD OF SUPERVISORS TO GIVE WELL DESERVED ACKNOWLEDGEMENT AND RECOGNITION TO THE ROTARY CLUB OF GLAND ON THE CELEBRATION OF ITS 30TH ANNIVERSARY.

AND WHEREAS THE ROTARY CLUB OF GLAND RECEIVED ITS CHARTER FROM ROTARY INTERNATIONAL IN OCTOBER, 1995.

AND WHEREAS FOR THE PAST 30 YEARS, THE MEMBERS OF THE ROTARY CLUB OF GLAND HAVE SUPPORTED AND PARTICIPATED IN SIGNIFICANT HUMANITARIAN EFFORTS ON A LOCAL AND INTERNATIONAL LEVEL UNDER THE MOTTO OF SERVICE ABOVE SELF.

AND WHEREAS THE GLAND ROTARY SIGNATURE SERVICE PROJECTS ARE KNOWN AS THE WOODCHUCKS PROGRAM, WHICH PROVIDES FREE WOOD TO FAMILIES AND GLAND WHO USE FIREWOOD AS THEIR PRIMARY SOURCE OF WINTER HEATING CATCH CITIZENS AND THE COMMUNITY HEROES EVENT TO SHOW LOVE AND APPRECIATION TO OUR FIRST RESPONDER COMMUNITY ROTARY HOLIDAY MEALS FOR WHICH CLUB MEMBERS DELIVER THANKSGIVING AND CHRISTMAS MEALS TO NEEDY FAMILIES AND COMMUNITY PARTNERS AWARDS BANQUET, WHICH PROVIDES A SUBSTANTIAL MONETARY AWARD TO COUNTY EMPLOYEES WHO HAVE DEMONSTRATED SERVICE ABOVE SELF OUTSIDE OF THEIR DAILY WORK.

AND WHEREAS GLIN ROTARY GRANTS AND SERVICE PROJECTS RANGE FROM ROADSIDE CLEANUP, MEALS ON WHEELS, GLIN CARES GLAND, HABITAT FOR HUMANITY GLAND EDUCATION FOUNDATION, GLAND CASA GLAND PET LOVERS, THE GLAND HISTORICAL SOCIETY GLAND, YMCA BOY SCOUTS OF AMERICA TROOP SEVEN 10 LIBERATION VETERAN SERVICES, GLAND DAY FOUNDATION, AND THE GLAND CHRISTMAS MOTHER.

AND WHEREAS THE GLAND ROTARY PROVIDES GRANTS AND SUPPORT IN THE SPIRIT OF A PUBLIC PRIVATE PARTNERSHIP WITH GLAND COUNTY GLAND FIRE RESCUE, THE GLAND SHERIFF'S OFFICE, GLAND PUBLIC SCHOOLS, AND GLAND RECREATION AND PARKS.

AND WHEREAS THE GLAND ROTARY ALSO DONATES CHILDREN'S BOOKS TO LOCAL SCHOOLS, SPONSORS A LOCAL FOURTH AND FIFTH GRADE ESSAY CONTEST PROVIDES MENTORS FOR STUDENTS SPONSORS OF TWO TO TWO TO SIX HIGH SCHOOLERS, TO ROTARY YOUTH LEADERSHIP ACADEMY, AND SPONSORS AN ANNUAL $3,000 SCHOLARSHIP FOR A SELECTED HIGH SCHOOL SENIOR THAT RESIDES IN THE COUNTY.

AND WHEREAS THE GLAND ROTARY CONTINUES TO INSPIRE, ASSIST, AND EDUCATE COUNTLESS MEMBERS AND VOLUNTEERS LEAVING A POSITIVE AND LASTING EFFECT ON THEIR COMMUNITY AND THE SURROUNDING REGION.

NOW THEREFORE BE IT RESOLVED THAT THE GLAND COUNTY BOARD OF SUPERVISORS HEREBY ACKNOWLEDGES COMMENDS AND RECOGNIZES THE ROTARY CUB OF GLAND ON ITS 30TH ANNIVERSARY AND ITS EXTRAORDINARY COMMITMENT TO THE COUNTY.

UM, I THINK, I THINK IT WAS JUST HERE PROBABLY TWO WEEKS AGO FOR THE MAKEUP FOR DECEMBER.

BUT AS YOU KNOW, WE, WE WERE IN SNOW MODE LAST MONTH, AND, UM, EVERYTHING WORKED OUT PRETTY GOOD.

UH, SO, UM, BACK IN DECEMBER, WE RECEIVED A CONDITIONAL APPROVAL FOR THE INTERCHANGE ACCESS REPORT, UM, FROM THE FEDERAL HIGHWAY ADMINISTRATION, BASICALLY GIVING US THE THUMBS UP FOR A DIVERGING DIAMOND.

UM, SO THAT WAS, THAT WAS ONE OF THE FIRST DOMINOES TO FALL, UM, TO CONTINUE THE PROJECT FORWARD.

UM, SO, UH, SINCE THEN, A COUPLE OTHER THINGS HAVE HAPPENED.

UH, THE PROJECT HAS TRANSITIONED FROM A TRADITIONAL DESIGN BID BUILD TYPE OF PROJECT TO DESIGN BUILD.

UM, SO WHY IS THAT IMPORTANT? A

COUPLE THINGS THAT IT ALLOWS US TO DO IS, NUMBER ONE IS DELIVER THE PROJECT PROJECT ABOUT A YEAR EARLIER.

UM, SO, SO THAT'S GOOD.

AND I'LL GO OVER THE SCHEDULE, UM, IN A LITTLE BIT.

UM, IT ALSO GIVES THE, UH, DESIGN BUILD TEAM THAT'S SELECTED THE ABILITY TO GET INNOVATIVE AND CREATIVE WITH HOW THEY'RE GOING TO, UH, CONSTRUCT THE PROJECT.

SO WHAT WE WILL DO IS WE WILL DESIGN IT TO ABOUT 30, 40% PLANS, AND THEN WE WILL PAUSE, UM, AND WE WILL SOLICIT, UH, BIDS FOR, FOR THAT DESIGN BUILD TEAM, AND THEN, UH, MOVE FORWARD.

THEY WILL BE RESPONSIBLE FOR, UH, COMPLETING THE DESIGN WHILE ALSO ACQUIRING RIGHT OF WAY RELOCATING UTILITIES AND COMPLETING CONSTRUCTION.

SO THAT, THAT IS WHAT WE ARE, UM, PROGRESSING TOWARDS, UH, NOW WITH THE PROJECT AS FAR AS DELIVERY.

UM, ANOTHER THING THAT WE DID WHEN WE DECIDED TO GO DESIGN BUILD IS, I HOPE YOU ARE FAMILIAR WITH THE HICKORY HAVEN PARK AND RIDE PROJECT, UM, WHICH IS IN THE SAME AREA.

THOSE PROJECTS ARE NOW GOING TO BE BUNDLED TOGETHER AS ONE.

UM, AND THE INTENT IS TO REALLY KEEP TWO CONTRACTORS FROM STEPPING ON EACH OTHER'S TOES AND FRANKLY, DON'T WANT TO BE OUT A A YEAR BUILDING A PARK AND RIDE, AND THEN COMING BACK SIX MONTHS LATER AND STARTING TWO YEARS WORTH OF CONSTRUCTION ON THE, THE DIVERGING DIAMOND.

SO, UM, SO THAT'S, THAT'S IT IS GOING TO BE DELAYED SLIGHTLY.

UH, THE PARK AND RIDE PROJECT, IT IS SUFFICIENTLY DESIGNED.

UM, WE'RE GETTING TO THE POINT WHERE WE'RE ABOUT TO ACQUIRE RIGHT OF WAY.

THAT'S WHERE WE'RE GONNA HIT THE PAUSE BUTTON, LIKE I SAID, BUNDLE IT WITH THE DDI.

SO, UM, SO IT WILL BE DELAYED, BUT I THINK FOR GOOD REASONS BEING BUNDLED WITH THE, THE, THE LARGER PROJECT.

OKAY.

UM, THE BUDGET, THE BUDGET FOR THE DD OR FOR THE PARK AND RIDE, IT IS FULLY FUNDED.

SO GOOD NEWS.

UH, THE DDI RIGHT NOW IS TRACKING ABOUT A $3 MILLION GAP, UM, ABOUT A $79 MILLION PROJECT.

THERE'S ABOUT 75, 70 $6 MILLION AVAILABLE.

I, I TELL YOU THAT, JUST TO LET YOU KNOW THAT WE ARE EXHAUSTING ALL OF OUR OPTIONS TO REFINE THE ESTIMATE, CLEAN IT UP, AND GET IT WITHIN THE BUDGET.

OKAY? THAT BEING SAID, WE ALSO KNOW THAT THERE'S A CHANCE THAT THAT MIGHT NOT HAPPEN, AND WE WILL EXHAUST ALL OPTIONS TO GET STATE FUNDING RATHER THAN COMING BACK TO THE BOARD.

UM, YOU KNOW, AS YOU KNOW, LETTING YOU KNOW THAT WE NEED ADDITIONAL MONEY.

SO THAT, THAT IS SOMETHING I WANT YOU GUYS TO BE AWARE OF.

UM, AND IT IS SOMETHING THAT WE'RE JUST TRACKING AS A RISK ITEM.

UH, SO AS FAR AS THE SCHEDULE, THERE IS AN UPCOMING RISK WORKSHOP, UH, WHICH IS REQUIRED AS PART OF THE DESIGN BUILD PROCESS THAT WILL INCLUDE VDOT PERSONNEL, THAT WILL INCLUDE OUR CONSULTANT WHO'S DOING THAT 30 TO 40% DESIGN PRIOR TO ISSUING THE DESIGN, BUILD, BUILD, UM, PROCUREMENT PROCESS.

UM, AND WE WOULD LIKE TO INVITE GLAND COUNTY.

SO, UM, THAT'S EXPECTED TO BE IN MARCH, END OF MARCH.

UH, I'LL WORK WITH, UH, UCHIN COUNTY STAFF, UH, ABOUT WHO WOULD BE THE APPROPRIATE PERSON TO JOIN THAT RISK WORKSHOP.

UM, BUT JUST WANNA LET YOU KNOW THAT'S COMING AND, AND YOU GUYS WILL BE, UH, A PART OF THAT TEAM.

THE REST OF THE SCHEDULE.

UM, AND THEN AT THAT POINT, UH, WE'LL GO THROUGH, WE, WE'LL START THE PROCUREMENT PROCESS, GETTING REQUESTS FOR QUALIFICATIONS, AND THEN A REQUEST FOR PROPOSAL FROM THE TEAMS. UM, AND THEN AT THAT POINT, WE'RE TRACKING A CTB AWARD DATE OF SEPTEMBER OF 2026.

RICHMOND WAS THE NUMBER ONE REGION TO RECEIVE PROJECTS, AND GLIN RECEIVED THREE.

SO WE, WE ONLY, BASED ON OUR POPULATION AND WHAT WE CONTRIBUTE, WE CAN ONLY APPLY FOR FOUR PROJECTS.

WE WERE APPROVED FOR THREE OF OUR FOUR PROJECTS, THOSE BEING, UM, UH, THE, AND THE NUMBER ONE SCORING PROJECT IN THE REGION WAS THE FAIRGROUNDS ROAD AND MAIDEN ROAD, UH, ROUNDABOUT, UH, WE GOT $5.1 MILLION OF THE TOTAL COST OF 8.4, THE 2 88 SOUTHBOUND AUXILIARY HARD SHOULDER RUNNING LANE.

UH, WHICH IF YOU REMEMBER, WE HAD GOTTEN AWARDS FOR THE NORTHBOUND RUNNING LANE.

IT'S A 29, 21 $0.9 MILLION PROJECT.

WE'RE AWARDED 14.4, AND THEN ALSO IMPROVEMENTS TO THE TWO 50 AND 2 88 INTERSECTION, UM, TO THE TUNE OF 22.4 MILLION.

THE COEFFICIENT OF DISPERSION, WHICH IS A STATISTICAL TERM, IS A MEASURE FOR ASSESSMENT UNIFORMITY.

NOW, THE OTHER THING IS TO NOTE THAT THE VIRGINIA LOCALITIES AND PART OF THE STATE CODE AT THE VERY BOTTOM OF THIS SLIDE INDICATES THAT, UH, IS EXPECTED TO MAINTAIN ASSESSMENT RATIOS NO LOWER THAN 70% OR HIGHER THAN 130 TO BE IN COMPLIANCE WITH THE CONSTITUTIONAL AND STATUTORY MANDATES.

THE VICINITY MAP SHOWS THE LOCATION OF THE SUBJECT PROPERTY IN THE RED CIRCLE, AND THE AERIAL PHOTO MAP SHOWS THE SUBJECT PROPERTY OUTLINED IN RED.

THE ZONING MAP SHOWS THE SUBJECT PROPERTY AND THE SURROUNDING PROPERTIES ZONED A TO AGRICULTURAL LIMITED.

THE COMPREHENSIVE PLAN SHOWS THE SUBJECT PROPERTY DESIGNATED AS RURAL ENHANCEMENT AREA AS ARE ALL THE SURROUNDING PROPERTIES.

THE 58 ACRE PARCEL IS USED AS A RESIDENT AS WELL AS FOR FARMING ACTIVITIES.

THE APPLICANT WILL BE STAYING ON THE PROPERTY WHEN THE SHORT TERM RENTALS ARE BOOKED.

THE PRIMARY PARKING AREA WILL BE GRAVEL, WOULD BE GRAVEL LOT WITH 38 PARKING SPACES WITH A SEPARATE OVERFLOW PARKING.

EVENT ACCESS WOULD BE AT THE WESTERN ENTRANCE ON RIVER ROAD WEST AND AN EMERGENCY VEHICULAR ACCESS MUST BE PROVIDED TO, TO BOTH EVENT AREAS.

UH, THE EVENT TERRACE, WHICH WAS SHOWN ON THE, UM, CONCEPTUAL PLAN AS WELL AS THE POOL, THEY'RE REQUESTING TO OPERATE FROM MARCH TO NOVEMBER WITH NO EVENTS BEING HELD ON EASTER SUNDAY.

MEMORIAL DAY OR LABOR DAY EVENTS WOULD OCCUR ONLY ON FRIDAY THROUGH SATURDAY WITH NO EVENTS BEING HELD MONDAY THROUGH THURSDAY.

A MAXIMUM GUEST, UH, MAXIMUM OF 150 GUESTS WOULD BE ALLOWED WITH THE MAXIMUM 12 EVENTS PER YEAR.

EVENTS THAT WOULD BE HELD ON THE TERRACE WOULD BE HELD FRIDAY THROUGH SUNDAY FROM 1:00 PM TO 10:00 PM WITH ALL AMPLIFIED SOUND ENDING AT 9:00 PM AND ANY EVENT WITH AMPLIFIED SOUND MUST OCCUR WITHIN TENTS WITH BARRIERS ON ALL SIDES.

RIVER CLIFF RIVER CLIFF SUBDIVISION IS THE NEXT CLOSEST OCCUPIED AREA TO THE WEST WITH THE CLOSEST HOUSE BEING APPROXIMATELY, UH, 1080 FEET FROM THE EVENT TERRACE.

THE ESTATE AT RIVER RUN IS THE NEXT CLOSEST, WHICH IS APPROXIMATELY 21, UM, FEET AWAY, 2100 FEET AWAY, EXCUSE ME.

AND THE NEIGHBORS TO THE EAST ARE THE FURTHEST FROM THE EVENT TERRACE, WHICH ARE APPROXIMATELY TWENTY THREE HUNDRED AND TWENTY NINE HUNDRED FEET AWAY.

SO THE ESTATE AT RIVER RUN IS AN EVENT VENUE LOCATED ADJACENT TO THE PROPERTY, UH, TO THE SUBJECT PROPERTY TO THE WEST.

THEY RECEIVED THEIR INITIAL CUP APPROVAL, WHICH WAS IN 2019, AND THE APPROVALS OCCLUDED 900 ATTENDEES PER EVENT UP TO UP TO 40 PRIMARY EVENTS PER CALENDAR YEAR WITH THE FOLLOWING CONDITIONS.

SIX OF THOSE PRIMARY EVENTS WERE AT WITH AMPLIFIED SOUND COULD BE HELD OUTDOORS WITHIN A STRUCTURE ENCLOSED ON ALL SIDES.

THEY WERE LIMITED TO A FOUR HOUR PERIOD ENDING BY 10:00 PM WITH ALL AMPLIFIED DEVICES ORIENTED TOWARDS THE RIVER WITH NO SUBWOOFERS.

AND THIS HAD A FIVE YEAR EXTENSION, UH, EXPIRATION DATE, EXCUSE ME, IN 2024.

THEY WERE APPROVED FOR A RENEWAL OF THIS CONDITIONAL USE PERMIT.

SOME OF THE REVISED AMENDMENTS INCLUDE A MAXIMUM OF 500 ATTENDEES PER EVENT, 150 PER CALENDAR YEAR, 150 EVENTS PER PER CALENDAR YEAR, AN UNLIMITED AMOUNT OF OUTDOOR ACTIVITIES, AND A STRUCTURE WITH SIDE PANELS.

AT THE PUBLIC HEARING, NOBODY SPOKE IN OPPOSITION.

UM, OF, UM, ANY OF THE CONDITIONS FOR THE RENEWAL.

A COMMUNITY MEETING WAS HELD IN MARCH OF 20 24 15.

CITIZENS ATTENDED AS WELL AS PLANNING.

COMMISSIONER COSBY DISCUSSIONS INCLUDED THE TYPE OF EVENTS TO BE HOSTED, OPERATIONS OF THE EVENTS AND SHORT TERM RENTALS, NOISE, TRAFFIC, SIGNAGE, PARKING, AND THE EXISTING FARM ACTIVITIES ON OCTOBER 30TH, 2024, BY INVITATION OF THE APPLICANT, 11 NEIGHBORS AS WELL AS SUPERVISOR WINFREY AND SPOON HOWER ATTENDED A MEETING ON THE PROPERTY.

UM, PRIOR TO THE SCHEDULING OF THE SEPTEMBER 19TH PLANNING COMMISSION MEETING, WHEN THIS WAS ORIGINALLY, UH, PLANNED TO BE HEARD BY THE PLANNING COMMISSION, NEIGHBORING RESIDENTS REQUESTED A MEETING WITH, UH, MR. WINFREY, DISTRICT THREE BOARD OF SUPERVISORS REPRESENTATIVE AND JESS JESS MCLAUGHLIN, DISTRICT THREE, PLANNING COMMISSIONER AND STAFF TO DISCUSS CONCERNS WITH THE APPLICATIONS.

AT THIS MEETING, TOPICS INCLUDED EXISTING ACTIVITIES AND NOISE ASSOCIATED WITH THE PROPERTY, NOISE AND TRAFFIC ASSOCIATED WITH THE TWO VENUES OPERATING NEXT TO EACH OTHER AND THE POTENTIAL TRESPASSING ON ADJACENT PROPERTIES FROM SHORT TERM RENTAL GUESTS.

PRIOR TO THE PLANNING COMMISSION MEETING, STAFF RECEIVED 14 EMAILS, TWO PHONE CALLS, AND ONE IN PERSON VISIT.

VISITOR, UH, FROM A CITIZEN EXPRESSING CONCERN ABOUT THE PROPOSED EVENT VENUE IN SHORT-TERM RENTALS.

CONCERNS WERE RELATED TO THE NUMBER OF EVENTS, LOUD MUSIC HEARD AT PRIVATE EVENTS ON THE SUBJECT PROPERTY, THE USE OF THE PRIVATE SHOOTING RANGE ON THE SUBJECT PROPERTY, AND THE SHORT-TERM RENTALS BEING OPERATED WITHOUT A CONDITIONAL USE PERMIT.

STAFF RECEIVED FOUR UM, EMAILS IN SUPPORT OF THE APPLICATION.

SINCE THE PLANNING COMMISSION MEETING IN DECEMBER, STAFF RECEIVED THREE EMAILS IN OPPOSITION THAT WAS ABOUT, UH, THAT WAS AS OF FOUR 30 THIS AFTERNOON AND ONE EMAIL.

IN SUPPORT OF THIS APPLICATION, THERE HAVE BEEN SOME CODE ENFORCEMENT ISSUES ON THE PROPERTY, UH, FOR THE SHORT-TERM RENTAL.

AT THE TIME WHEN THE APPLICANT APPLIED FOR THE CONDITIONAL USE PERMIT, THEY HAD ALREADY BEEN OPERATING IN OPERATION OF TWO UNHOSTED, UH, SHORT-TERM RENTALS.

UM, IN TALKING WITH THE APPLICANT, THEY STOP THE SHORT TERM RENTAL BOOKINGS, UH, WHILE THE APPLICANT, WHILE THE APPLICATION IS STILL PENDING.

IN ADDITION, THE APPLICANT PLACED A PREFABRICATED SHED TO HOLD FARMING EQUIPMENT ON THE PROPERTY WITHOUT A PERMIT.

UM, FARM USE DOES NOT REQUIRE A PERMIT, BUT BECAUSE THE BUILDING IS IN THE FLOODPLAIN, IT WOULD REQUIRE A CONDITIONAL USE PERMIT FOR IT TO REMAIN WHERE THE APPLICANT COULD REMOVE IT TO ABATE THE VIOLATION.

UM, THE APPLICANT HAS DECIDED TO MOVE THE STRUCTURE OUT OF THE FLOODPLAIN.

SO WITH THE IMPOSED CONDITIONS TO LIMIT THE NUMBER OF EVENTS, GUESTS HOURS OF OPERATION, AND WITH A THREE YEAR OPERATION PERIOD BEFORE, UM, EXPIRATION FOR THE PUBLIC PLACE OF ASSEMBLY, THIS USE IS IN COMPLIANCE WITH THE COMPREHENSIVE PLAN.

AT THE DECEMBER 19TH, 2024 MEETING, THE PLANNING COMMISSION RECOMMENDED APPROVAL OF THIS APPLICATION WITH A FOUR ONE VOTE.

MR. PATAK VOTED AGAINST THE RECOMMENDATION FOR APPROVAL AT THE PUBLIC HEARING.

11 CITIZENS SPOKE IN SUPPORT OF THE APPLICATION WHILE SIX CITIZENS SPOKE IN OPPOSITION.

OPPONENT STATED THE STATED CONCERNS WITH THE PUBLIC ASSEMBLY PORTION OF THE APPLICATION, SAFETY CONCERNS RELATED TO FIREARMS AND THE POTENTIAL FOR EVENT CONFLICTS WITH TWO WEDDING VENUES IN SUCH CLOSE PROXIMITY NOISE FROM THE MUSIC ASSOCIATE AND NOISE MU ASSOCIATED WITH BOTH EVENT VENUES.

SO, UH, THE FOLLOWING CONDITIONS WERE RECOMMENDED BY THE PLANNING COMMISSION.

UM, THERE ARE 40 CONDITIONS AND THEY'RE DIVIDED INTO THREE SEPARATE SECTIONS.

UM, MY HUSBAND HAS MANY, MANY YEARS OF TRAINING AND IS LEGALLY ABLE TO TRAIN OTHERS IN GUN SAFETY.

SO WHY ARE WE HERE? UM, IN 2020 WE DECIDED TO MAKE BIG CHANGES.

UM, A LOT OF THINGS WERE HAPPENING IN 2020, NOT JUST FOR US.

I THINK THE WHOLE, THE WHOLE WORLD.

UM, SO WE STARTED LOOKING FOR FARMS. WE STARTED LOOKING FOR LAND, FOR IDEAS TO HAVE SMALL BUSINESSES THAT WE COULD, UH, MANAGE THINGS ON OUR OWN AND PROVIDE FOR OURSELVES AND OUR COMMUNITY.

SO THAT'S WHEN WE FOUND MOUNT BERNARD FARM.

UM, ABSOLUTELY FELL IN LOVE WITH IT.

SOME OF YOU HAVE BEEN ABLE TO COME VISIT.

IT'S ONE OF THE MOST CHARMING PLACES, I THINK IN GOLAND, A LITTLE BIASED.

UM, IT HOLDS SOME HISTORICAL CONTENT TO THE COMMUNITY AS WELL.

UM, SO WE'VE BEEN USING IT AS A TOOL TO TEACH OUR CHILDREN VALUES, SUCH AS THE FARMING, BUT ALSO ABOUT, UH, PROVIDING FOR YOURSELF, OWNING YOUR OWN BUSINESS, UM, HOW TO MANAGE, UH, DIFFERENT, DIFFERENT THINGS WHEN YOU'RE, WHEN YOU ARE SELF-EMPLOYED.

UM, AND SO SOME OF YOU HAVE ASKED, AND WE'VE HEARD IN THE LAST MEETING, THERE COULD BE BETTER FITS FOR YOUR PROPERTY THAN WHAT WE'RE TRYING TO ACHIEVE, UM, OURSELVES.

UM, SO WE FEEL LIKE IT'S BEEN AN INTERESTING BALANCE TO TRY TO NAVIGATE WHAT, WHAT WE DREAM OF AND WHAT WE WOULD LIKE TO PURSUE VERSUS KEEPING THE PEACE WITH OUR NEIGHBORS AND, AND OUR COMMUNITY.

UM, SO JAMIE WENT OVER WHAT, YOU KNOW, A LITTLE BIT ABOUT WHAT WE'RE TRYING TO ACCOMPLISH.

UM, OUR TOTAL ACREAGE IS ABOUT 130.

SO, UM, WHEN YOU SAW THE MAPS, WE DO FEEL LIKE THERE IS ENOUGH LAND FOR ALL THIS TO HAPPEN.

WE HAVE TONS OF FORESTS IN BETWEEN OUR NEIGHBORS TREE LINES THAT WE INTEND TO PRESERVE.

UM, AND I THINK MR. LYLE, SOMETHING I WANTED TO TALK TO YOU ABOUT LATER WAS, UM, CON CON UH, OH, GETTING THE WORD MY CONSERVATION THANK YOU.

CONSERVATION EFFORTS.

UM, I WAS TOLD YOU, YOU MIGHT KNOW MORE ABOUT THAT.

SO PRESERVING THE LAND, KEEPING IT RURAL, THAT'S KIND OF OUR BIG, OUR BIG IDEA WITH THE PROPERTY.

UM, WITH FARMING, WE'VE, WE'VE DISCOVERED MANY CHALLENGES, WHICH THAT'S THE WAY FARMING GOES.

WE KNEW THAT WHEN WE SIGNED UP FOR IT.

UM, SO WE WANTED TO FIND A BALANCE OF KEEPING THE PROPERTY BEAUTIFUL THE WAY IT IS, UM, TO SHARE IT WITH OUR COMMUNITY.

AND THIS WAS OUR DREAMS. THESE WERE WHAT WE FELT WE COULD MANAGE AS A FAMILY, UM, LONG TERM.

AND SO WE CAME UP WITH THE IDEA OF HAVING THE SMALL VENUE, NOTHING HUGE LIKE NEXT DOOR.

UM, SOMETHING THAT WE CAN MANAGE WITH PROFESSIONALS.

SO, UH, AGAIN, THAT WAS SOMETHING VERY IMPORTANT FOR OUR NEIGHBORS TO KNOW, IS THAT WHEN YOU HAVE A VENUE, YOU HAVE SOMEBODY IN CHARGE THAT UNDERSTANDS THE INDUSTRY, UNDERSTANDS THE RULES, AND MAKES SURE THAT NO SHENA SHENANIGANS ARE GOING ON.

SO WE HAVE THAT ALL, YOU KNOW, PLANNED TO HAVE THAT ALL SET UP IF THIS GETS APPROVED.

UM, WE'VE WORKED REALLY HARD WITH JAMIE TO COME UP WITH WAYS THAT THIS WILL BE SOMETHING THAT, YOU KNOW, ISN'T OVERBURDENING THE NEIGHBORS', OVERBURDENING THE STATE OF RIVER RUN, SOMETHING SMALLER, DIFFERENT, SOMETHING PROBABLY MORE AFFORDABLE FOR THE COMMUNITY AS WELL.

I, YOU KNOW, I THINK THAT'S A, A BIG NEED FOR OUR COMMUNITY.

WE DON'T HAVE HOTELS EXCEPT FOR THE SHORT PUMP AREA.

UM, AND AGAIN, I JUST WANNA EMPHASIZE, NEVER EVER HAVE WE EVER WANTED ANYONE TO BRING GUNS OR, OR MOTORIZED VEHICLES TO OUR PROPERTY AND, AND RUN AROUND AND TRESPASS.

WE'RE KEEPING AN EYE ON THINGS.

AND YOU CAN JUST SORT OF SEE, THERE'S JUST SO MANY TREE LINES AND THINGS IN THE, THAT SEPARATE US FROM OUR NEIGHBORS.

UM, ONE OF THE, FROM THE LAST MEETING, ONE OF THE MEMBERS OF THE COUNCIL HAD RECOMMENDED, MAYBE INSTEAD OF MUSIC GOING TOWARDS THE RIVER, IT COULD GO TOWARDS OUR OTHER LOT, WHICH IS THAT WHOLE GROUP OF TREES, UM, TO THE EAST OF, UH, HEADING TOWARD THE GOOD PROPERTY.

WE WERE JUST HAVING A PRIVATE PARTY.

IT WAS ABOUT 20 DECIBELS.

SO I THOUGHT IT WAS INTERESTING.

I LOOKED UP WHAT DOES 20 DECIBELS SOUND LIKE? AND IT WAS A RUST OF LEAVES OR A WHISPER FROM FIVE FEET AWAY.

SO I FEEL IF WE PUT IN THE CONTROLS THAT WE'VE BEEN PROVIDED BY THE COUNTY, UM, ALONG WITH PROFESSIONALS THAT ARE HELPING US WITH THE VENUE, I, I REALLY THINK WE CAN MAKE THIS HAPPEN.

THERE'S PROBABLY GONNA BE TONS OF BUSINESS THAT COMES TO US AND WE'RE NOT THE FIT FOR THEM.

NOW THAT LIMIT THE MUSIC WATTAGE OUTPUT OR THE MUSIC VOLUME DURING THE SPECIAL EVENTS, UM, THOSE WILL BE NECESSARY TO CONTROL PROPAGATION OF THE MUSIC BEYOND THE MOUNT BERNARD PROPERTY.

THE ONLY PERMIT, THE ONLY PROFIT THAT IS MADE IN THE PERMIT TO CONTROL NOISE IS DIRECTING ITSELF OR TOWARD THE RIVER, WHICH UNFORTUNATELY DIRECTS IT DIRECTLY AT, UH, THE ESTATE AT RIVER RUN.

UH, MS. ORO HAS SUGGESTED DIRECTING IT TO THE DEEPER WOODS BETWEEN THE GOOD PROPERTY AND, UH, THE ESTATE AT RIVER RUN, UH, WHICH IS A GREAT IDEA, BUT IT'S NOT IN THE PERMIT.

UM, THESE ARE THINGS THAT NEED TO BE ADDRESSED, UM, AS FAR AS THE NOISE GOES, YOU KNOW, UM, AS A GROUP, WE RESPECT THE RIGHTS OF THE MOUNT BERNARD FARM OWNERS, UH, TO USE THEIR LAND IN CON IN CONJUNCTION WITH THE CURRENT ZONING.

SEVERAL MONTHS AGO, I WAS PART OF A NEIGHBORHOOD GROUP OF CONCERNS, CITIZENS THAT MET AT THE ADMIN BUILDING TO TALK ABOUT THIS CUP.

I HAD DONE SOME RESEARCH TO SEE IF THERE WERE ANY VENUES THAT WERE NEXT TO EACH OTHER IN THE COUNTY, AND CURRENTLY THERE ARE NOT.

THERE'S NOT ONE.

UM, HAVING A VENUE NEXT TO ANOTHER CREATES PROBLEMS, CONFLICTING NOISE, TOO MUCH NOISE, TOO MUCH TRAFFIC, AND TOO, TOO MUCH COMMERCIAL DEVELOPMENT IN AN, IN AN AREA THAT IS MEANT TO BE RURAL AND PEACEFUL.

UH, NUMBER TWO, IF THERE'S A VENUE, THERE'S GOING TO BE LOUD MUSIC AND THERE WILL BE REVELRY AND WE WILL HEAR IT.

I'M RIGHT ACROSS THE STREET FROM MOUNT BERNARD.

WE HEAR OUTDOOR EVENTS FROM RIVER RUN, AND THEY ARE EVEN FURTHER OFF THE ROAD THAN MOUNT BERNARD.

THE OROS HAVE EVERY RIGHT TO HAVE PARTIES TO CELEBRATE AT THEIR FARM, BUT A VENUE DIRECTLY ACROSS THE ROAD IS ALL TOGETHER DIFFERENT AS FAR AS I I'M CONCERNED AND WILL GENERATE AN EXCESSIVE AMOUNT OF NOISE.

NUMBER THREE, MY UNDERSTANDING IS THAT THE PLAN, AND IT WAS CONFIRMED TONIGHT WHEN I SAW IT FOR THE ENTRANCE TO THIS VENUE, IS TO ENTER DIRECTLY ACROSS FROM OUR EXISTING AND ONLY ENTRANCE AND EXIT.

THAT SPOT IS ALREADY A TROUBLESOME SPOT FOR TRAFFIC.

SINCE CARS AND TRUCKS COME OVER THE CREST OF THE HILL THERE, I HAVE FOUR GRANDCHILDREN THAT IN THE NOT TOO DISTANT FUTURE WILL BE DRIVING.

AND THAT INCREASES MY CONCERN.

I HAVE NO PROBLEM WITH SHORT-TERM RENTALS.

IT'S A GOOD WAY TO GET AN INCOME, AND I REALLY HOPE THAT WE CAN COME TO SOME RESOLUTION THAT WILL MAKE US ALL HAPPY.

I AM GREATLY WORRIED WITH THE CONCEPT OF A PROFESSIONAL, BUT SOMEBODY BROUGHT IN JUST FOR A SPECIFIC WEDDING WHO ONLY HAS THAT CLIENT'S INTEREST AT AS THEIR CONCERN.

THEY DON'T CARE ABOUT THE COUNTY'S INTERESTS AND THE NEIGHBORING VENUE'S INTERESTS.

YES, THEY MIGHT BE A PROFESSIONAL, BUT AT THE END OF THE DAY, THEY'RE ONLY GONNA SERVE THAT ONE CLIENT, UM, AS BEST AS THEY CAN.

AND WE DO HAVE TO CONSIDER PROXIMITY OF VENUES WHEN WE DEAL WITH THIS.

AND I DO THINK WE HAVE TO SIDE SIDE WITH THE EXISTING, UH, BUSINESS THAT'S BEEN THERE, THAT'S SHOWN A LONG TRACK RECORD OF OPERATING WITHIN THE VERY STRICT GUIDELINES WE'VE APPLIED TO THEM.

I CAN HEAR THOSE SPEAKERS CRYSTAL CLEAR AND I THINK, YOU KNOW, WE, WE DEAL WITH IT BECAUSE THEY HAVE REALLY PUT IN MASSIVE AMOUNTS OF INVESTMENT AND CARED FOR THINGS LIKE SOUND AMPLIFICATION TO THE UTMOST DETAIL.

THERE ARE NO UNCERTAINTIES THERE, THERE ARE JUST TOO MANY UNCERTAINTIES RELATED TO THIS.
