HOWEVER, VSP IS CONFLATING THAT OUR ACCEPTANCE OF RECREATIONAL FIREARM USE MEANS THAT WE WOULD ALSO ACCEPT THE PUBLIC USE RANGE BEING PROPOSED IN OUR BACKYARDS.
UM, THIS IS NOT JUST DISINGENUOUS AND DECEPTIVE BUT OUTRIGHT INSULTING.
IT IS PRECISELY BECAUSE WE ARE FIREARM ENTHUSIASTS THAT WE KNOW HOW LOUD THIS VSP RANGE WILL BE WITH UPWARDS OF 21 SHOTGUNS FIRING CONTINUOUSLY ON TOURNAMENT DAYS AT ALL SHOOTING STATIONS.
WE ACCEPT OUR INDIVIDUAL NEIGHBOR'S FIREARM USE AS CONSTITUTIONALLY PROTECTED.
HOWEVER, WE CONTEND THAT A PUBLIC USE RANGE PLACED AMONG FAMILY HOMES IS AN INFRINGEMENT OF OUR PROPERTY RIGHTS AND A VIOLATION OF DUCHEN COUNTY'S NOISE ORDINANCE THAT RESIDENTS SHOULD BE ABLE TO USE AND ENJOY THEIR HOMES FREE FROM REPETITIVE NOISE THAT RISES TO THE LEVEL OF A NUISANCE GLAND COUNTY ALSO REQUIRES THAT CUP APPLICANTS SHOW THAT THE PROPOSED USE WILL NOT HAVE AN ADVERSE IMPACT ON THEIR SURROUNDING NEIGHBORHOOD.
MY COMMENTS WILL FOCUS PRIMARILY ON THE SOUND ISSUES RELATED TO VSPS PROPOSAL AND THE ADVERSE EFFECT THAT THE GENERATED NOISE FROM THIS PROPOSAL WILL INFLICT UPON ITS IMMEDIATE NEIGHBORS.
THEIR APPLICATION INCLUDES 14 SHOOTING STATIONS, A S***T STATION, A WOBBLE STAND, AND A FIVE STAND ARRANGED IN A SEMI-CIRCULAR FASHION ON LAND DESIGNATED BY THE DEQ AS A RESOURCE PROTECTION AREA.
DUE TO THE WETLANDS OF DEEP CREEK, THE LAND HAS BEEN LOGGED WITHIN THE LAST DECADE AND VSP IS PROPOSING ONLY 50 FEET OF VEGETATION AND EARTH AND BERMS TO A HEIGHT OF ONLY EIGHT FEET ABOVE SHOOTING STATIONS, BUT ONLY IN SELECT AREAS AND ONLY WHERE DRAINAGE PERMITS OF THESE SHOOTING STATIONS.
TWO ARE POSITIONED 400 FEET FROM THE PROPERTY LINE SHARED WITH MR. JOSE LEANDRO AND HIS PRIMARY RESIDENCE IS ONLY 600 AND 700 FEET FROM THESE STATIONS.
THE FRONT DOOR HERE OF THE UCHIN ADMINISTRATION BUILDING FROM THAT DOOR, IT IS ONLY 400 FEET TO THE CROSSWALK INTERSECTION WITH 5 22 AND ROUTE SIX.

MY THREE MAJOR CONCERNS ARE EXCESS NOISE LEAD INTRODUCED TO THE WETLANDS ON SITE AND THE INCREASE IN VEHICLE TRAFFIC.
I'LL START WITH THE INCREASE IN TRAFFIC.
THE TRAFFIC IMPACT ANALYSIS PROVIDED BY VSP UNDERREPRESENTED THE IMPACT OF THE ADDITIONAL TRAFFIC TO THE AREA.
THE TIA UNDERREPRESENTED THE IMPACT IN TWO KEY WAYS BY FOCUSING ONLY ON THE TWO CLOSEST INTERSECTIONS.
THE ANALYSIS IGNORES THE ALREADY DANGEROUS THREE CHOP ROAD AND BROAD STREET INTERSECTION NEAR DE MOORE'S MARKET.
ONLY ONE MILE AWAY THAT STOP HAS POOR VISIBILITY AND THE INCREASE IN TRAFFIC MEANS DEMO'S, MARKET CUSTOMERS, RESIDENTS, AND VSP VISITORS UNFAMILIAR WITH THE DANGEROUS LOCATION OR CONDITIONS AT THAT LOCATION WILL LEAD TO MORE COLLISIONS.
THE OTHER WAY THE TIA UNDERREPRESENTED, UH, THE IMPACT IS BY CATEGORIZING THE LAND USE AS A GOLF COURSE ITE CODE FOUR 30 RATHER THAN MORE ACCURATE LAND USE LIKE MULTIPURPOSE RECREATIONAL FACILITY ITE CODE 4 35 OR MORE APPROPRIATELY PERFORMING A STUDY SPECIFIC TO THE ACTUAL PROPOSED LAND USE.

AND THE TIA DOESN'T TAKE INTO ACCOUNT THE FREQUENT EVENTS, COMPETITIONS AND TOURNAMENTS ADVERTISED ON THE VSP WEBSITE, WHICH WOULD HAVE DOZENS OF PEOPLE GRO SHOWING UP FROM THE SAME START TIME FOR THE SAME START TIME MULTIPLE TIMES A YEAR, UH, MANY TIMES A MONTH.
WE MUST REQUIRE VSP TO PROVIDE ANOTHER TRAFFIC IMPACT ANALYSIS REPORT THAT MORE FAITHFULLY MODELS THE ACTUAL CONDITIONS AROUND THE PROPOSED SITE, INCLUDING THE THREE THREE CHOPPED AND BROAD STREET INTERSECTION YEAR BO MARKET.
WE MUST RESTRICT THE HOURS OF OPERATIONS AND THE NUMBER OF EVENTS PER MONTH AND YEAR.
NO OTHER RANGE OPEN TO THE PUBLIC IS OPEN SEVEN DAYS A WEEK, NOR ARE THEY OPEN EVERY HOUR OF DAYLIGHT AS PROPOSED IN THE CUP.
MY SECOND MAJOR CONCERN IS NOISE.

VSP POINTED TO THE FACT THAT OTHER VE UH, VIRGINIA OUTDOOR GUN RANGES HAVE HOMES NEARBY BASED ON MY RESEARCH INTO BULL RUN SHOOTING CENTER, CENTRAL VIRGINIA SPORTING CLAYS, FLYING RABBIT SPORTING CLAYS AND CAVALIER SPORTING CLAYS.
NONE OF THEM HAVE HOMES CLOSER THAN 1400 FEET, MOST HAVING HOMES AT LEAST 2000 FEET AWAY AND ALL OF THEM HAVING A LOWER DENSITY OF POPULATION OR AFFECTED HOMES BY AN ORDER OF MAGNITUDE THAT IS 10 TIMES LESS OR FEWER HOMES NEAR THE SITE.

THEIR CONDITIONAL USE PERMIT INCLUDES RESTRICTIONS AROUND THE DECIBEL LEVELS ALLOWED AT THE PROPERTY LINES, UH, AT NO MORE THAN 72 DECIBELS.
I SUGGEST THAT WE IMPOSE THAT SAME RESTRICTION IF THIS CONDITIONAL USE PERMIT WERE TO GO THROUGH.

THE PROPOSED VSP SITE SITS RIGHT ON TOP OF A WETLAND ACCORDING TO THE VIRGINIA DEPARTMENT OF CONSERVATION RECREATION, VIRGINIA DEPARTMENT OF QUA, UH, ENVIRONMENTAL QUALITY AND THE US FISH AND WILDLIFE SERVICE, THE SITE IS ALSO RIGHT NEXT TO A FEMA FLOOD HAZARD AREA.
VSP HAS NOT PROVIDED ANY LEAD MANAGEMENT PLAN WITHOUT A PLAN IN PLACE.
THERE'S AN EXTREMELY HIGH PROBABILITY OF LEAD ENTERING THE P**N WATERSHED AND CONTAMINATING THE WATER OF THOUSANDS OF PEOPLE DOWNSTREAM.
WE MUST REQUIRE VSP PROVIDE A LEAD MANAGEMENT PLAN THAT IS CERTIFIED BY THE EPA AS MEETING THE BEST MANAGEMENT PRACTICES FOR LEAD AT OUTDOOR SHOOTING RANGES WITH A CERTIFICATE OF RECOGNITION AND ONGOING EVIDENCE THAT THEY'RE FOLLOWING THE PLAN.
WE MUST REQUIRE VSP NOT ALLOW THE FIRING OF WEAPONS OVER OR INTO WETLANDS, FLOOD PLANS OR WATERWAYS UNDER ANY CIRCUMSTANCES.

IN SUMMARY, THE UCHIN COUNTY PLANNING COMMISSION AND BOARD OF SUPERVISORS SHOULD REQUIRE VSP TO PROVIDE A REVISED TRAFFIC IMPACT ANALYSIS REPORT THAT MORE FAITHFULLY MODELS THE ACTUAL CONDITIONS AROUND THE PROPOSED SITE REQUIRE VSP TO PERFORM A FORMAL NOISE STUDY TO ASSESS THE IMPACT OF THE RANGE NOISE ON THE NEARBY RESIDENTS.

UM, UH, ONCE AGAIN, VSP HAS NOT CONDUCTED A FORMAL SOUND STUDY.
THEY DID NOT PROVIDE ANY DETAILS ABOUT THE INFORMAL STUDY THEY CONDUCTED IN AUGUST.
